WASHINGTON — A federal judge has tossed out most of the government’s evidence against a terrorism detainee on grounds his confessions were coerced, allegedly by U.S. forces, before he became a prisoner at Guantanamo Bay.

Well, this certainly explains Obama's impromptu terrorism speech yesterday: The Federal prosecutors surely had forewarning that this ill wind was about to blow, just in time to make Obama look even stupider if he didn't get out ahead of this news and say something... anything.

So, Obama makes an irrelevant speech and the next day the fawning news media's talking points focus on how resolute the CIC is, and how 'Buck Stops Here' Obama is just like JFK taking responsibility after the Bay Of Pigs.

Obama's entire speech yesterday was orchestrated to get out ahead of this bad news that the idiots in the White House created in the first place. I'm thoroughly convinced.

This country is being led by a second rate Chicago city alderman with no practical executive experience whatsoever and was just 20 years ago running the cash register at Baskin-Robbins 31 Flavors.

Bingo.

I’ll be surprised if they are convicted. AFAIK practically all of the evidence against them was collected counter to US judicial standards and will be thrown out.

I don’t see any way these Gitmo guys can be convicted. Holder “guaranteed” they would not be freed. Isn’t that evidence of an unfair trial and enough to overturn any conviction we may get? It just looks like obama/holder have stacked the deck for the terrorists and against us.

Yes, and didn't obama promise the same thing? It just looks like they stacked the deck to set the terrorists free.

I agree. Wouldn't a judge almost be derelict if he DIDN'T throw out the charges?

pnh is exactly right
“I really cannot fault the judge for this. It is illegal to coerce a confession from a criminal suspect in the US criminal justice system.”

The system exists for civilians in our country.
These terrorists are not civilians.
We are pretty well screwed once it was decided to try them as civilians, whether it is KSM or the knickerbomber.

If you read the whole link you see the Judge did decide that other confessions given by these muslim are valid and can be used to hold him

the Judge was appointed by Reagan. I don ‘t think he had any choice in how he ruled.

The choice should be to NOT try them as civlians

I know people like to blame Zero for *everything* & hate facts, but:

The Obama administration argued this guy should be kept locked up, the tactics the judge disagreed with were done on Bush's watch, and the judge is a Reagan appointee.

See this book,....

Unholy Alliance: Radical Islam and the American Left (Paperback)

The bestselling Unholy Alliance-now in paperback! Former Leftist radical David Horowitz blows the lid off the dangerous liaison between U.S. liberals and Islamic radicals. With America's battle against the disastrous force of terrorism at hand, Horowitz takes us behind the curtain of the unholy alliance between liberals and the enemy-a force with malevolent intentions, and one that Americans can no longer ignore.

The blame rests squarely on those who determined that this was a criminal matter

In this case, no one decided that. It's a habeas case.

And people were upset that these cretins were being detained without representation - now justice will prevail/sarc (after they’re set free they can rejoin their terrorist masters and plot their next attacks).

You know, Eric Holder was “very confident” in his cases against the Gitmo terrorists. He said so. Hahaaa...

This is from the article:

********************************EXCERPT*********************************

Despite Hogan’s concerns about the 23 statements, the judge relied on other evidence and three statements Al Madhwani made to a military tribunal and a review board to conclude that he trained, traveled and associated with members of al-Qaida, including high-level operatives. On those grounds, the judge ruled he is legally detained.

BS. The Obama Administration decided to take military detainees and try them in civilian courts. The blame rests clearly on Obama and Holder’s shoulders. The judge made the only decision that could be made under the circumstances. This was completely predictable and why opponents argued that detainees in the War on Terror should be tried in military tribunals NOT civilian courts. The only people to dense to predict this (or possibly want the terrorist to work) are the left-wing wackjob liberals in 0’s Administration.

This is why War Crimes don't belong in Civilian Courts, even for evidential hearings.
