Actually, this means it will stay open indefinitely. Congress isn’t going to suddenly get a greater Democrat majority; in fact, the Dims may lose both houses in 2010. If they can’t get the votes for the bucks now, they won’t get them at all. Obama isn’t going to be re-elected in 2012 because the U.S. economy is going to collapse before that, so Guantanamo is a done deal.
Obama, as the highest military authority, would need to review and approve any convictions obtained in the military tribunals. This would mean he would have to uphold or exonerate the Muslim terrorists, which burden he does not wish to have. (He does not wish to alienate his friends).
By sending them to a civilian court system, he passes on nothing, but retains the power of the pardon.
This is why, in my opinion, the Gitmo is being shut down, and the prisoners are being tried in civilian courts. No blame, but at the last miniute in office, he can free them.
