A senior military official in Washington says the lead prosecutor in the Fort Hood shooting case will be a man who secured the death penalty in a similar case four years ago.

The official told The Associated Press on Friday that Col. Michael Mulligan will head the prosecution of Maj. Nidal Hasan. The official spoke on condition of anonymity because they were not authorized to discuss the investigation.

Hasan is charged with 13 counts of premeditated murder and 32 counts of attempted premeditated murder in the Nov. 5 Texas Army post shooting.

Mulligan prosecuted a 2005 case in which Sgt. Hasan Akbar was sentenced to death for a 2003 attack on comrades in Kuwait that left two dead and 14 wounded.

It's a shame that Sgt. Hasan Akbar is still alive and sitting in a cell at Leavenworth ..

Excellent choice for the prosecution.

It does. And, the UCMJ does allow charges to be filed for the murder of an unborn child, just like in Federal law. However, that particular specification has never been tested in court, and to my knowledge has only been filed in one previous case. With the complexity of this particular case, it's probably best not to test this new charge with this trial, IMHO.

I had forgotten that the Sgt. who rolled the grenade under the tent was also named Hasan.
However, I will resist any and all profiling based on name.
Funny, though, it’s been a month and a half, and Maj. Hasan has ALL BUT BEEN FORGOTTEN. That’s what a media blackout can do.

It continues to gall me that the media ignore the unborn in the number of people murdered by this maniac.

COUNTERTERRORISM BLOG.org: "NEFA BACKGROUNDER: SGT. MAJOR HASAN AKBAR AND 2003 ATTACK ON FELLOW SOLDIERS" by Madeleine Gruen (SNIPPET: "In Kuwait, in March 2003, Army Sgt. Major Hasan Akbar killed two fellow military officers and wounded 14 others in an attack that bore many similarities to the November 5, 2009 mass shooting at Fort Hood by Muslim American Major Nidal Malik Hasan. Both Akbar and Hasan were born and raised in the United States, and both had personal, academic, and military careers punctuated with difficulty and failures. Both were influenced by militant brands of Islam...") (January 7, 2010)
