Virginia Homeowner’s Board Orders 90-year-old Medal of Honor Winner to Remove Flagpole, or Else!

In a priority mail five-paragraph letter, the Coates & Davenport law firm in Richmond has ordered Colonel Van Barfoot to remove the pole by 5 p.m. Friday or face legal action. According to the letter, Barfoot would have to pay all legal fees and costs if the legal proceeding pursued by Sussex Square Homeowners Association is successful.

Family members say Barfoot is the most decorated American combat veteran alive. He has been awarded more than 20 medals, including the Medal of Honor, The Silver Star, the Legion of Merit, The Bronze Star, and three Purple Hearts. This fall, his native state of Mississippi named a portion of a highway after him and a building at McGuire Veterans Hospital in Richmond, Virginia, is named in his honor...

It’s safe to say the Sussex Square Homeowners Association is made up by a bunch of pathetic losers. My guess is they will reverse their decision after the fall out.

At the very least there will be an out pouring of support for Colonel Van Barfoot along with donations to help pay any legal fees.

It’s just sad...

These planned communities and the Home Owners Association Boards that rule them are mini, mind controlled Communist enclaves. George Orwell’s predictions coming true incrementally.

Yes - voting (for a Board of Directors) by the residents does occur - but iron rules and regulations are written, in advance, by the developers. Subsequent, elected resident Board members are the little Hitlers of collectivism. Unpaid fines for infractions can actually result in home confiscation, or the threat of same.

Check out PUDs (Planned Unit Developments) before you buy. Your landscaping is subject to your neighbors’ approval.

In the USA - a man’s home is no longer his castle as this sad story illustrates.

Two sides to the story I am sure. I like Homeowner regulations that are followed. Flagpoles in ours, are everywhere and quite beautiful.

I think the board and people need to vote on this, as I can’t imagine a homeowners association feeling this way.

Let them take you to court. Get donations. I’m happy to throw in. And as part of discovery, inspect every single home in the association. Every one. For every thing! Inside and out. Anything found in the homes to be out of code or against the HOA will be reported. Ask the judge for a continuance each time a new code violation is found. Stating that until the HOA performs it’s responsibilities to the fullest, it is unconstitutional for them to enforce this term.

Within a few weeks of these homeowners being Alinsky’ed (Make them live up to their own rules) the HOA will learn that they have just bit off a whole lot more than their budget can chew. You will find that at least 90% of the homes in any Association are “out of compliance” with one thing or another. Can’t prosecute me without prosecuting every item. The judge will play along for a while, then throw the case out when it becomes clear that the HOA is not worried about all of the terms, only the ones the choose to enforce.

Don’t give in. Ping me when it’s time to give. This is outrageous and these HOAs should not be allowed to include terms like “aesthetically pleasing” as that it a completely subjective term - one rife with discrimination and racism and bigotry.

If my strategy doesn’t work. Claim to be a gay muslim illegal immigrant community organizer. That should work.

Wow... maybe the dumbest move by an HOA, ever.

Just sent the story in to my local (SE Virginia) TV stations and newspaper. Lots of military down here, let's see if they pick it up.

Barfoot is wrong. He was attracted to the development because of the rules that produced an attractive development. He could of picked outside. Now he wants to pick and choose the rules. Why not every one else get to pick and choose what rules they want to obey?

The problem is more general than partisan politics. HOA busybodies regard most veterans and other healthy men as “arrogant males.” Their effeminate husbands support their intrusions against the property rights of said “arrogant males.” They also tend to use local governments as tools of competition against their less affluent neighbors.

My Dad has been in Heaven for nearly thirty years. He was career AF and served multiple tours in VietNam. I miss him every day, but I am somewhat relieved that he is not alive today to see what has happened to his country that he fought so valiantly for.

He would have been an VERY active and vocal FReeper.

The HOA’s are just as bad in Florida. I will never buy property with an HOA....they have too much power.

HOAs are so bad in Central Florida I have to deal with each different one depending on who I visit. One HOA security guard ripped off my car-magnet promoting my business...said I could not have it on my car. When the guy got snotty with me, I called the local law enforcement and pressed vanadlism charges.
