Cannot Defend Terror Trial in NYC
“Startling!”
That’s how one legal expert describes a recent exchange between a Republican senator and the U.S. attorney general regarding the prosecution of Khalid Sheikh Muhammad and suspected terrorists in federal court.
Senator Lindsey Graham (R-South Carolina) in a Judiciary Committee hearing last week asked Attorney General Eric Holder a question that befuddled the nation's top cop could not answer.
Sen. Graham asked: "Can you give me a case in United States history where a[n] enemy combatant caught on a battlefield was tried in civilian court?"
The inquiry was followed by an extensive silence before Mr. Holder said: "I don't know. I'd have to look at that. I think that, you know, the determination I've made. . ."
"We're making history here, Mr. Attorney General," Sen. Graham said. "I'll answer it for you. The answer is 'no.'"

Even FDR had uninformed enemy combatants (German spies) shot, and I do not recall ever hearing that they had their miranda rights given to them in advance?!
This is all about putting Bush and Cheney on trial, any other explanation is just simply disingenuous.

I like the idea of having enemy combatants shot - perhaps someone will step up and do the job our Attorney General and President are unwilling to do!

I can imagine the “defendants” released with sincere apologies, and given homes and 7-11 franchises in the DC area as compensation. (Or perhaps “Obama Home-style chicken” shops?)
I truly hope a really good attorney will rise up to defend New Yorkers and all the nation from this foolhardy, completely illegal, decision, and take Holder to the ground.

Understand something:
People cultivate and hold standards, principles and convictions SO THAT in a crisis, NO EQUIVOCATING OR HESITATION may interfere with preserving what is most important…. And in the US right now … our safety and sovereignty are most important!!
Where are the standards, principles and convictions America’s founders fought for and which have been passed down as a most precious legacy to all of us, decade after decade??? Ask the clowns in Hollywood … last I saw, these people mocked and trivialized our birthright to sell tickets!
I would suggest that people go back and review the German attempt to prosecute four intellectuals that headed the Baader Meinhoff Gang (The Red Army Faction).
It was eventually decided that the trial had to be open to the public and common law values used in the prosecution of the four.
From day one on...the Meinhoff four basically gave zero respect to the case or their defense. The judges were treated like school yard kids and were never able to get a real court operating. The crowd that gathered daily...watched a circus and generally laughed at the court events.
In the end...this daily aggravation lifted the spirits of Meinhoff supporters and they started new attacks on German political figures, which finally culminated with a terrorist hijacking (the hijacking ended in total failure for the hijackers).
At this key point...the Meinhoff intellectuals all committed suicide in their cells. The case ended....and the judges simply closed the book on a failed court case with no conclusion.
I believe there is much to learn from this experience...but Holder has taken the attitude of repeating the experience...with nothing much to gain. Just imagine if Ossama were captured.

It wouldn’t surprise me if the defense moved for dismissal on the grounds that the US Justice Dept has no standing to bring charges against them.....

THE Military holds the enemy combatants. The Military does not work for Attorney General Holder. President Obama directly approved the transfer from Military to the AG.

In every gasthaus I visited, there was a poster with the picture of each member of the gang. As each member was captured or killed, a big, beautiful "X" was drawn over the perp's picture.
