A woman accused of holding down a child while her husband sexually assaulted the girl — an act captured on video — pleaded guilty in a Travis County courtroom Friday and was sentenced to 40 years in prison.
Mariana Garcia's punishmentfor two counts of aggravated sexual assault was part of a plea bargain with prosecutors. The charges carry a maximum sentence of life in prison.
Charges are pending against Garcia's husband, Adrian Navarro, 30.
Garcia, 24, showed little emotion during the proceedings before state District Judge Bob Perkins. At one point, prosecutor Joe Frederick asked her whether Navarro is her husband and whether he is the person in the video. She said "yes."
Outside court, Garcia's lawyer, Bradley Urrutia, said she was emotionally abused by her husband and acted under his control. He said that the plea agreement does not require her to take part in his trial. However, if she were called to testify, she would have to do so because she has pleaded guilty in the case.
Frederick said outside court that a tattoo helpedinvestigators identify Garcia as the one "helping her husband with the sexual act." Frederick said another child was shown in the video looking on.
The girl being assaulted in the video appeared to be younger than 2, a police affidavit said.
A computer hard drive that held the video was discovered after a detective went to Garcia's apartment along Interstate 35 in South Austin on Jan. 22 during a search for stolen property, the affidavit said. The detective also found photos determined to be child pornography.
Navarro told police that he got the pornography from a relative and had meant to throw it away, the affidavit said.
On the hard drive, detectives found more than 500 photographs and more than 15 videos of child pornography, the affidavit said.
One of the videos showed the couple assaulting the child, the affidavit said.
Austin police child abuse unit Detective Joel Pridgeon, who was in court for Garcia's plea, has previously called the case "shocking."
After their apartment was searched, the couple fled to Tejupilco, Mexico, where Garcia, a Mexican citizen, has family. Mexican authorities discovered them with the help of U.S. marshals. Navarro, a U.S. citizen, was deported by Mexican officials and arrested when he arrived in San Antonio in January.
Mexican authorities formally extradited Garcia in June. Both are being held in the Travis County Jail.

A relative who works as a police detective in the area of sexual abuse told me that women are appearing more frequently in these cases and that in some cases, it is even the women who are the primary child abusers. She said the common denominator is that these women watch large amounts of porn.
For many years statistics have shown that most children who are murdered are murdered by their mothers. Mom’s boyfriend comes in second place followed by Dad.

Be careful not to confuse correlation with causation - it might be that viewing porn causes people to do sick things like this, but it might also be that the sort of person who would do this anyway is also the sort of person who would seek porn. Wearing baggy pants doesn’t turn one into a murderer, even though a lot of murderous gang members wear baggy pants. Even if porn vanished tomorrow and stayed gone there would still be sickos who rape children (or hold them down for others).

However, in the underlying data, they define "fathers" to include step-fathers and common law husbands. "Male acquaintances" are almost always Mom's boyfriend. Also, it is unclear whether they include neonaticides (children murdered during the first 24 hours after birth), which are almost always committed by mothers.
Most child murders are neonaticides and infanticides (murdered during the first year after birth).
