Thus, Holder and obama can do as they damn well please. Who is going to stop them? Thus far, no one has.
All Obama has to do is tell Gates to turn them over. Of course, he would then have to personally take the responsibility, something which he is loathe to do.

That is it in a nutshell. You’re correct but if these 9/11 terrorists succeed in getting even more ‘lawyered up’ any judge has to throw the case out because they were not read their miranda rights. I have heard horrific stories of the terrorists crying torture and abuse (while they had it made in Gitmo even with issued prayer rugs and respect) from the ACLU’s mouth to Obama’s big ears.
It is definitely on Obama no matter what and sadly I really don’t think Obama cares about anything but putting Bush/Cheney/CIA on trial as Obama himself wants this more than the safety of this country.
Either that or it’d be grounds for an appeal against conviction (and he will be convicted, BHO said so).

Remember a high ranking military official months ago when Obama first ordered the break up of their military courts and Gitmo, saying

Does Obama have the authority to force the resignation or to fire Robert Gates? If he does, he will simply fire Gates and replace him with another lackey who will do whatever the zero tells him, legal, illegal, or unconstitutional.
Bottom line: This was/is Obama’s decision, not Holder’s.
