Our system of criminal justice works on the theory of “innocent until proved guilty”. This being the case, how can Holder be so confident that KSM will never be released. How about on a technicality?, specifically never having been read his Miranda rights.

How about the rules of evidence and discovery. How much information about America's intelligence gathering will be opened for all the criminals to see.
