Kenneth Gladney Beating Case Remains in Limbo

On Aug. 6, the same day the White House told its supporters to “punch back twice as hard,” black conservative Kenneth Gladney found himself at the receiving end of several of those punches. He was beaten by a group of thugs from the Service Employees International Union after they found him selling conservative memorabilia outside Bernard Middle School, the site of of a South St. Louis County health care town hall meeting hosted by ultra-liberal Rep. Russ Carnahan (D-Mo.).

On page 6 of the 24-page police report published today by the folks at BigGovernment.com, a police officer highlights the recollection of witness #1, Harris Himes:

Witness H. Himes stated that as he was leaving the school gymnasium, he saw Suspect McCowan talking to Victim Gladney. He stated he saw Suspect McCowan reach over the table and punch Victim Gladney in the face. This assault knocked the victim off balance. Suspect Molens then went around the table and pulled Victim Gladney over the table backwards by the back of his shirt collar. He began to punch and kick Victim Gladney. Witness H. Himes added that while Suspect Molens was kicking and punching Victim Gladney, Suspect McCowan then joined in on the assault.

Witness #2’s, Sandra Himes’, statement of the incident concurred with Harris’ account of the incident. She did add that Victim Gladney did nothing to provoke this assault.

Today, more than three months have passed and Gladney, a 39-year-old, 130-lb. diabetic and leukemia survivor, is still waiting for justice. Still waiting, despite the fact that the police report seems to state the case clearly enough that any prosecutor — even St. Louis County Prosecutor Bob McCulloch, whose name has appeared on this blog before — could prosecute the SEIU thugs and win.

Why the delay? Inquiring minds want to know.

I've been thinking that the “UNIONS” is ripe for a ACORN/Prostitute type investigation. It would be dangerous, but extremely interesting and groundbreaking for someone to infiltrate, document and report on their tactics. I'd venture to say that the ACORN fraud would pale in comparison.

Meanwhile, after being indicted in September, 2005, Tom DeLay is still waiting for his day in court. After the most serious charges were thrown out by the presiding judge, the Democrat prosecutors in Austin were determined to press on with their flimsy evidence supporting the other charges, at least in the media. They continued to put off the court date until it was no longer necessary. Why bother with an actual trial? DeLay was tried and convicted in the media and chose not to run for re-election.

Expect the SEIU thugs who assaulted Gladney to get slaps on their wrists after plea bargaining. It will be timed so as to coincide with a major news story that will keep the union thug story buried on the back pages, if the story is reported at all. Violence:  Organized Labor’s Unique Privilege

Is it a great leap to assume a privilege to commit violence in pursuit of a goal when the privilege already exists in pursuit of another goal?

Gladney doesn’t have to delay.

He can start a civil action for assault annd battery in state court,

AND

he has a case under the Civil Rights act in which he can sue the thugs AND the SEIU who the thugs were acting for.
MILLIONS! Its a federal court case.

My guess is that Gladney has made the mistake of hiring a lefty dem lawyer to represent him. He needs a conservative/libertarian firebrand of a lawyer.

Gladney should not be whimping out here. He needs a new lawyer from flyover country.

My father was a victim of union violence when his coal mining operation was shut down by union thugs. And his company was non-union!
