Maj Nidal Malik Hasan could become the first person to be sentenced to death by a military court in almost 50 years.
The US Armed Forces has a death penalty – lethal injection – but there have been no executions since 1961 when an army private, John Bennett, was hanged for rape and attempted murder.
The military can also impose a sentence of life imprisonment without parole and there are nine men on its death row at Fort Leavenworth, Kansas.
A "convening authority", a high-ranking officer, will decide whether the government will seek the death penalty. If so, it has to be resolved by trial before a panel of servicemen and women.
The death sentence can be imposed only if the panel unanimously agrees on four points. Some are similar to those on civilian juries but they also include the specifically military consideration of whether the offence was committed to avoid hazardous duty or knowingly endanger a mission.

I, too, have weakened in my stance supporting the death penalty.
I believe it should be reserved for certain capitol crimes in which there is no doubt the accused/convicted individual did the grisly deed, such as at Fort Hood.
Execution gives him the easy way out, and he can be called a martyr for islam. Better to let him live out his days paralyzed, being tended by nurses (most of them female I hope), and constantly reminded that a woman took him down.
Sometimes, living is more terrible than dying.

Given his bachelorhood status, I'm not sure if he's interested in the 72 virgins awaiting him in "Rag Head Heaven" or not.
I heard a cutie (a/k/a: groaner alert) yesterday: Do you know where whores go to prepare themselves to receive this blown up Islamic fools in heaven; answer: The Virgin Islands. Told you!
If he's paralyzed, let him live. He deserves to suffer before facing his maker.
Why give him what he wants? Why not sentence him to life with no possibility of parole, in a solitary cell where he has no contact with any outside materials or other prisoners?
Send a message to the Muslim world and any others in our military who might be now thinking about 'going out in a blaze of glory' to instantly reach their 72 virgins.
Make him wait a long, long time. Keep him healthy to extend his solitary life as long as possible.
In other words, sentence him to his own personal Hell on Earth.
It would be worth the monetary expense.
Come on now,
He may have had a difficult childhood.
Others may have teased and scorned him for his religion.
Compassion?
NAHH, just hang him on television for the world to see.

Either that or pray that he dies on his own. Executing this monster, although he deserves it, will make a hero out of him to other home grown Jihadis. They will use his execution as call to arms and do more damage here at home.

Why is there no outcry for the people HE executed?
More than likely with the fear of PC and bad (always) press, the Army will not execute him.
