Naked Justice: Arrested for Nudity in His Own Kitchen

You’re standing in your kitchen making coffee. You are naked, but no one else is home. It’s early in the morning and you are in the privacy of your own home. All right, so maybe you’re a little bit odd, and maybe not everyone makes coffee naked. But your house, your rules, right?

That’s probably what Virginia resident Eric Williamson was thinking last Monday morning as he made himself coffee while dressed in nothing but his birthday suit. Unfortunately for Williamson, he wasn’t quite as alone as he thought. Walking through his yard were a woman and her seven-year-old son, on their way to the son’s school. The woman — a wife of a police officer – saw Williamson’s naked torso through his window and called the cops. Williamson was arrested and charged with indecent exposure.

There are some disputed accounts of this story. It is unclear precisely what time of the morning it happened and whether or not the man moved to another window as the mother and child walked across the lawn in order to remain in their range of vision.What’s not in dispute here is that the man was in his own home and the mother and kid were on his property, walking across his grass.....

There was a program on C-SPAN a little earlier which was pretty scary--hosted by the Cato Institute and featuring Tim Lynch and Harvey Silverglate (author of Three Felonies a Day). Silverglate's thesis is that because of vaguely-written laws the average person will unknowingly commit three acts in the course of a day which could be construed as felonies (and old safeguards like the concept of mens rea have been largely eroded away), so if a prosecutor wants to go after you, you're sunk.

Lynch cited a case where a man was replacing the carpet in his home when he found a bullet under the carpet, put it aside and forgot about it. A while later his ex-girlfriend falsely accused him of stealing her stereo. When the cop showed up he let him into his home to see that the stereo wasn't there. The cop spotted the bullet, and because the man had a prior felony, he got a minimum 15-year prison term for possession of "ammunition" because of that one bullet.

yep. And she’s a police officer’s wife! Bad lessons for the kid. He’s learning to trespass and then complain and blame others, to top it all off. Maybe the mom was embarrassed when she saw the guy was nude and then tried to make it not her fault. A bad situation, not matter what.

Although this story seems generally sympathetic to the man, they do mention, not once, but twice, that he supposedly moved to a second window to "remain in their range of vision".

Not mentioned or even suggested is the very real possibility that he was watching to see what two people were doing on HIS lawn.

I think that it will probably come down to whether the exposure could be considered intentional. It sounds as though the man saw the woman and kid and then went to another window, where he could further expose himself, intentionally offending the woman to punish her for being in his yard.

I would expect that the case would be dismissed with a warning to both the man and the woman trespasser.

They didn’t bother to write what the women or his roomate said. Poor reporting. His roomate said that the guy was fired on Friday and was on a drunken binge running around the house with nothing but his hard-hat on.

He says his roomates weren’t home. They say they were home that morning.

“The roommate says “we wake up to Eric running around the house with nothing but a workhat on, butt naked, of course because he was drunk.”

When faced with the facts, Eric admits that he lied.

Eric says “at that time I was upstairs, downstairs without clothes on for several hours. And then I put some pants on. If she was walking down the road and said she saw me naked, it’s a good possibility but I don’t have a timeframe.

I have made coffee in the morning in my kitchen in the raw - just a walk by get the pot going before I get into the shower. Of course I live in a rural area!

I have a few problems with this, as summarized.

1st, I can imagine causing problems because you’re viewably naked in your own house. Doesn’t give you the right to be highly visible to all in the neighborhood. But, I’d hope the “victim” would simply ask the person to watch what they’re doing and cease & desist, rather than tattle-taling.

2nd, did this woman have “permission” by the man to walk across his property? I hope so; not only is it bad form for her, but she’s setting a directly bad example for the child. (This is a common problem in my area these days, where people DO NOT respect property. My next-door neighbor kids and their friends seem to all think they can just run across my front yard from their backyard to the next street - right in front of our house, literally, to boot. I’ve also caught ADULTS doing it with the kids. Never mind my old house with some wandering toddlers who thought the whole neighborhood was theirs for the taking.)

Don't believe anything in this story that the guy tells. In a phone interview he stated he couldn't really remember.

His roomates say he was drunk running around the house for hours naked except for his hard-hat.
