Shepard Faireys claim that he had the right to use a news photo to create his famous Barack Obama HOPE poster became a widely watched court case about fair use that now appears to have nearly collapsed.
By Friday night, his attorneys led by Anthony Falzone, executive director of the Fair Use Project at Stanford University said they intend to withdraw from the case and said the artist had misled them by fabricating information and destroying other material.
Fairey himself admitted that he didnt use The Associated Press photo of Obama seated next to actor George Clooney he originally said his work was based on which he claimed would have been covered under fair use, the legal claim that copyrighted work can be used without having to pay for it.

Oddly enough the nitty gritty of this story has been getting good coverage from TechCrucnh, and apparently the Noted Intellectual Property Thief Shepherd Fairey sent that blog a little mea culpa on Friday:
“The AP claimed it was one photo, and I claimed it was another. The new filings state for the record that the AP is correct about which photo I used as a reference and that I was mistaken. While I initially believed that the photo I referenced was a different one, I discovered early on in the case that I was wrong. In an attempt to conceal my mistake I submitted false images and deleted other images.”

Actually I would have thought Fairey had an open and shut case under “fair use”. The image was “political speech”, and did Fairey even profit from it?

There are no heroes here. Shepherd Fairey is a known Intellectual Property Thief in the art world.
Like everything else associated with this administration, it is based on lies!

Sergant was the "communications director" at the NEA, who was forced to resign a few weeks ago due to his ethical infractions.
He's not only a "Home Boy" of of Obozo (as it says on his t-shirt), but also a big promoter of Noted Intellectual Property Thief Shepherd Fairey, and in fact it was the recently-fired Sergant who promoted the "Hope" image stolen by Fairey, and which is the direct subject of the AP lawsuit.

You know, as little as I like or respect anyone involved in this entire thing. I think he changed Way more than enough to call it an original. he dropped some facial features, changed the shape of shadows. I am fairly certain that if you overlayed the two images they wouldn’t be a dead on tracing of most of it.
Credit for the photographers reference material should be given obviously.
That being said as an amateur artist, and a conservative,,,I hope they make him a little uncomfortable :)
