Judge Smacks Down 'Birther' Orly Taitz For Abusing Court

Federal District Judge Clay D. Land has slapped top birther Orly Taitz with a $20,000 fine for wasting the court's time, among other issues, with her constant filings after he, last month, dismissed her lawsuit against President Obama's right as commander-in-chief to deploy the military because he allegedly isn't legally president.

Because he didn't get rid of her the first time, he's hoping she gets the message this time from the barbed language in the 43-page order he issued Tuesday.

Right off the bat, on page 1 he writes:

For justice to be administered efficiently and justly, lawyers must understand the conditions that goven their privilege to practice law. Lawyers who do not understand those conditions are at best woefully unprepared to practice the profession and at worst a menace to it...

...When a lawyer recklessly accuses a judge of violating the Judicial Code of Conduct with no supporting evidence beyond her dissatisfaction with the judge's rulings, that lawyer abuses her privilege to practice law. When a lawyer abuses her privilege to practice law, that lawyer ceases to advance her cause or the ends of justice...

...Regrettably, the conduct of counsel Orly Taitz has crossed these lines, and Ms. Taitz must be sanctioned for her misconduct....

Among Taitz's missteps, she accused the judge of treason. That never works out well....

I figured out she’s a bit nuts a while ago. Her court filings were worse than pro se filings, and had a bit of the lunatic ravings you often see in them. She almost reminded me of Jack Thompson (disbarred for his rants, among other things).

She was not the right person to be representing this case.

In a country where laws are put into law without being read the woman is absolutely sane. {ie her “crazy” is FAR more reasonable AND defensible than the actions we’re getting from our government leadership.}

Odd that they couldn’t find this kind of judge in Alaska when the wackos up there were filing frivalous lawsuit after lawsuit against Sarah Palin.

And for those of you who are saying that Orley Taitz is nuts; you seem to be willfully neglecting the point that Obama could have made this all go away with a simple REAL birth certificate. The certificate he presented was not a birth certificate. My ex-wife had one of those from MA and when she tried to get her Concealed Carry license in New Mexico, they told her that they couldn’t use that and that they needed a REAL birth certificate. Instead Obama spends millions of someone’s money fighting it. Odd ...

Judge Land was a conservative Republican on the GA state legislature before being appointed to the federal bench by Pres. Bush (43). The judge in CA on whom everyone is hanging their hopes was, in fact, appointed by Clinton.

No lawyer can file the types of documents Dr. Taitz did in Judge Land’s court and not expect a severe sanction. As did you in your post, she accused Judge Land of colluding with “Obama’s goons,” i.e., AG Holder, because, supposedly, someone who looked like Holder was seen in a coffee shop across the street from the court on the day of the hearing. That may be OK to post at an online website, it is NOT ok to file in a federal court. Oh, and she went on to accuse thejudge of treason, and of being biased because he personally owns shares of 2 of America’s largest corporations.

There is just absolutely no excuse for a lawyer to do that, especially after being warned. She blew it big time.

I’d would lay odds that Land was appointed under a Democrat Admin..anyone know for sure?

Land was a conservative Republican State Senator who was appointed a judge by George W. Bush on the recommendation of Sheby Chambliss.

Land's decision was based not on any love for Obama, but on his disgust with Orly Taitz's wacky litigation style, and on his view (well-based in precedent) that civilian courts have no jurisdiction to review military orders. (The case was seeking to overturn the Army's order to an officer to deploy to Iraq. There is a ton of precedent that says that civilian courts can't overturn such orders.)

Apparently, in our Marxist corrupted courts citizens have “no standing” to question the emperor.

Fidel Castro could be nominated, and placed on ballots.. ( With thousands upon thousands of citizens screaming at their government officials the entire time to check his credentials).

Citizens ( products of our Marxist dominated government schools) could elect Fidel Castro. ( With constitutionally grounded citizens by the hundreds of thousands **vigorously** complaining to their elected officials and begging at their so-called “conservative” talk show weenies them to cover the issue.)

The Electoral College could vote for Fidel Castro for U.S. President. ( Again with thousands of citizen writing, faxing and calling in to object.).

Attorney Berg might even get Fidel's case all the way to the Supreme Court. ( With a minimum of 250,000 FedEX letters arriving begging the Supreme court to hear the case.)

The Congress could approve him.( With thousands of citizens writing, calling, and faxing in objection.)

And...Citizens have “no standing” to go to court and ask that our Constitution be upheld, and Fidel Castro’s natural born status examined.

Somehow, I don't think this is what our Founding Fathers had in mind.

Obama wont show his birth certificate because birthers like Orly end up making the whole movement look like idiots. Why would he want this to stop?

You do see Justices Roberts and Thomas in that picture, right? And, I'm quite sure that Alito and Scalia are in the room as well.

Is the Chief Justice also "violating the Judicial Code" when he swears in the VP or President? How about when they attend the State of the Union address?

Is this the same judge that it was reported met with AG Holder during the case? And his fine is for exercising her rights of free speech.

This happens a lot. A series, even hugh, issue arises and we support the nut clusters. Demonrats win because our dentist/lawyer/constitutional scholar gets 15 minutes of wacko fame.
