Home owner uses rifle to stop intruders

HAVERSTRAW (WABC) -- Police arrested two accused bandits after a home owner turned the tables on them.

Both suspects were still dressed in hospital attire after making their first court appearance on Monday.

Their alleged break-in at a Warren Avenue home didn’t quite turn out as planned.

Police say when the pair entered the house around 9:30 Sunday night, the homeowner grabbed his rifle.

“The confrontation escalated to the point where a couple of shots were fired. The two alleged perpetrators were both wounded, fled the scene and were apprehended a short time later by our police department,” Capt. Martin Lund said.

Officers searching the grounds of a nearby chapel found the apparently superficially wounded men hiding at the edge of the Hudson River.

Both Julio Urena, 17, and Juan Martinez, 25, are now charged with second degree robbery and second degree burglary.

Bail has been set at 50-thousand dollars each. The homeowner was not available and a family friend picking up the mail refused to comment, but others had plenty to say.

“I’m one of those people who believe you have the right to defend your home,” Charlie Di Carlo said. Di Carlo’s elderly aunt lives two doors from the scene of the crime. He believes the homeowner did the right thing.

This is obviously a hate crime perpetrated by the homeowner who will be summarily lynched by the public prosecutor in his NEW YORK town. NEW YORK is one of the states I now refuse to do business in, along with North Korea, Venezuela and several others.

This is an outrage! How dare this man shoot these robbers when he apparently had enough time to chamber a new round, to shoot the second robber, and they are both still alive!

This homeowner should be sentenced to 100 hours of familiarity with his choice of weapon, and target practice, and be required to pass a proficiency certification test!

Believe it or not, in New York, outside of the city, you do not need a license to purchase a rifle(min 16” barrel) or shotgun(min 18” barrel).

Having lived in both NY and GA I am struck by the differences in social norms regarding such events.

NY: homeowner waffles and contemplates the unclear legality of the appropriate response to the intruders. News viewers debate whether the right action is taken, esp. whether the intruders were given enough warning.

GA: “BANG!”. News viewers nod.

The rifle they showed on the graphic, not that it means anything, appears to be a 10/22. This had to be a fairly light caliber, so a 10/22 or other autoloader in .22 is fairly likely. I think I'd be emptying the 10 round mag in such a siutation. I'd hope that the perps would have numerous, 4-6 each, little bitty holes in their torsos. Of course I don't limit myself to my 10/22, in fact it sits in the cabinet. The M1 Carbine, loaded with a slightly downloaded magazine of soft point ammo, does not. Nor does the 1911A1 or the EAA Witness in .45 ACP, (230 grn Golden Sabre and 200 gr hydroshocks, respectively) Sometimes I take out the serious social purposes shotgun, but I don't' like the idea of the necessary cleanup after using that one. (nor that of being blinded and deafened by it's use).
