A, California -- Driving along a pockmarked road amid rocks and Joshua trees in a lonely southern California desert, religious controversy might be the last thing you'd expect to encounter.
And if you don't look too closely, you're likely to zip right past the focus of a hotly contested Supreme Court battle.
A federal judge has ordered the Mojave Cross, a war memorial erected by a veterans group 75 years ago, to be covered. It's boxed in plywood.
The issue is less about what the cross symbolizes and more about where it sits: In the middle of the Mojave National Preserve, which is government land.
The high court on Wednesday will consider whether the display violates the First Amendment's provision for a separation of church and state.

Thats sick. Very symbolic of a society that thinks 2 men can be “married” and lets pregnant mothers kill their babies.
The Mojave National Preserve was established in 1994. (That’s what I found.)
I am sickened by this.
So it wasn’t federal land when it was erected....but then became part of the ‘government’ when the land became a national park.
But, if they can transfer that little pocket of land to private ownership...we are home free. That is what they are deciding, right?
Well....lets hope for that decision. You would think it could be ‘grandfathered’ as almost a historical monument. After all, in the USA anything older than 75 years is an antique....we need to preserve these antique markers for history’s sake.
It’s hardly establishing a religion and we are far from regarding it as “Holy”. It’s a memorial.
How can it “violate” the Constitution? It’s been there for 75 years and is a free exercise of religion. Are sacred religious ceremonies held on Indian reservations a violation of the First Amendment?
The world is becoming more evil and that is what we are now seeing in the world...

This is when actual Americans in the area must stand up and tell the judge to go to hell.
If having a memorial cross out in the desert (where hardly anybody can see it) on government land offends them, I can just imagine how they feel about Arlington National Cemetery. That’s government land, isn’t it? I’ve seen several crosses there. *gasp* The horror... /sarc
This may come back to bite the liberals pushing this case. The appeals court ruled that the land transfer from the government to the VFW was illegal because it violated the “General Welfare” clause of Article II Section 8. It would be nice if SCOTUS were to rule that any law passed by congress must advance the general welfare; not just the “limited welfare” of a special interest group. The General Welfare clause was supposed to limit the government by requiring that the enumerated powers could only be used if they advanced the General Welfare and could not be used to advance only the welfare of a narrow special interest who might have political connections.
