"As soon as I sign this bill," President Obama promised in his prime-time address to Congress, "it will be against the law for insurance companies to drop your coverage when you get sick." Thunderous applause followed. It's easy to understand why - no one wants to lose their insurance coverage when they need it most.
But here's a news flash: It's already illegal for insurance companies to drop patients once they become ill. It has been for over a decade. The American people should take note, as President Obama is using this non-existent crisis to justify massive federal intervention in America's health sector.
Since 1997, federal regulations have prohibited insurance companies from raising a person's rates if he develops an illness. And no matter how sick a customer gets, an insurer can't drop him or refuse to renew his policy - provided he didn't lie on his application or move out of the state where his policy was issued.
Perhaps the President thinks this law isn't being enforced. He has repeatedly claimed that "no one holds these companies accountable for these practices." But that's not true. State insurance commissioners are charged with enforcing good-faith execution of insurance contracts. In fact, that's exactly what Obama's current Health Secretary, Kathleen Sebelius, did for eight years as Kansas state insurance commissioner.

On March 30, 2009 the Texas House of Representatives passed HCR 50 affirming that the State of Texas claims sovereignty under the Tenth Amendment.
You have publicly supported this bill, and stated that attorney generals from all over the union could be getting ready to sue the US Government.
We are asking you to take the lead.
We are asking you to order the Texas Attorney General to publicly begin working on a law suit under Article IV, Ninth, and Tenth Amendment of the Constitution.
We are asking you to protect the citizens of Texas that we will not stand for government controlled healthcare in our state.

The Tenth Amendment restates the Constitutions principle of Federalism by providing that powers not granted to the national government nor prohibited to the states are reserved to the states or the people.

Nah, he's talking about fraud cancellations. Preexisting condition exclusions are usually for a limited period (typically 90 days) and have been greatly reduced by HIPAA.
Fraud cancellations are open ended. You get sick, they pull the application. If you failed to disclose being treated for the condition in the past, it's 'adios amigo'. This is almost exclusively a situation involving individual (non-group) policies. They have the highest fraud potential, 'cause they're the ones an individual trying to get insurance after becoming sick tries to buy.
So, he's wrong in implying the issue occurs because of sickness, and he's also wrong in implying it's something an that impacts individuals with all forms of coverage. In other words, he's compounding overstatement with misstatement.

Here in New Hampshire, an insurance company was going to drop a young college student with cancer because her coverage was through her parents' policy as a full-time student, and the cancer treatments forced her to cut back her course load and lose her full-time student status.
This resulted in the passage of HR.2851, signed by President Bush just last year. So it's imprecise at best to say that it's been illegal for "over a decade."
