Guidelines on assisted suicide law will be published by the Director of Public Prosecutions this week to clarify when people are likely to be prosecuted.
Keir Starmer QC told the BBC factors that would be considered included whether anyone helping in the suicide stood to gain financially.
He said assisted suicide would remain an offence as the law was unchanged.
Labour minister Ed Balls said he hoped Mr Starmer would "err on the side of being very, very cautious".
The guidelines for England and Wales come after a legal battle won by Debbie Purdy, who has multiple sclerosis.
The Law Lords accepted earlier this year that Ms Purdy, from Bradford, had a right to know whether her husband Omar Puente would be prosecuted if he helped her to travel abroad to commit suicide.

When “some” killing allowed, it opens the door - the floodgates - to more and more killing. After all, there are so many people “suffering” who would be better of dead, who have no quality of life, who are useless, and worst of all, look funny and make other people feel weird and uncomfortable and are a drain on society.
And we know where it ended up a few decades ago, in Germany.

Lord Jesus, you healed so many people during your public ministry. I bring before you now, in prayer, all those who are terminally ill -- those afflicted with cancer, AIDS, and other illnesses.
|
Look lovingly and compassionately upon them. Let them feel the strength of your consolation. Help them and their families to accept this cross they are asked to carry. Protect them from euthanasia, Lord.
|
Let them see you carrying their cross with them, at their side, as you once carried yours to Calvary. May Mary be there, too, to comfort them.
|
Lord Jesus, I know and believe that, if it is your will, you can cure those I pray for (especially N.). I place my trust in you. I pray with faith, but I also pray as you did in Gethsemane: your will be done.
|
Bless us, Lord, and hear my prayer. Amen.
