$10,000 Sanction Proposed Against “Birther” Lawyer (Orly Taitz)

Federal Judge Clay Land may have made good on his threat of sanctions against a lawyer for an army officer fighting deployment on the claim that President Barack Obama was not born in this country. In an order today Judge Land denied a motion for a Stay of Deployment for Captain Connie Rhodes, filed by Attorney Orly Taitz yesterday. The motion was filed after Judge Land threatened sanctions and dismissed the complaint calling it frivolous. Taitz has 14 days to show why a $10,000 penalty as a sanction should not be imposed against her. We tried reaching Taitz. She has not returned our calls.

In a bizarre twist, News 3 has received a copy of a letter to Judge Clay Land, written by the officer in this case, Captain Connie Rhodes. In it she writes she is shipping out to Iraq and asks the Judge to withdraw the Motion to Stay the Deployment. She denies authorizing Taitz to file on her behalf.

No, they aren’t the seditionists. They may be all sorts of other things, but not seditionists. Those however who make common cause with people who would foment mutiny in the ranks, especially in time of war, are very real, dangerous seditionists. They are the enemies of our military and should be treated accordingly.

You shriek about a “Commie judge” and then support those whose conduct could lead to a collapse of the military command structure? Some of us here on FR, perhaps an ever declining number, I’ll admit, put and are putting everything on the line for our service men and women. And now on a site which prides itself on supporting the military, we see a developing forum for anti-military sedition because Obama got elected. Its disgraceful.

No, it's a constitutional question. Is Obama eligible to be president? Is he or isn't he a natural born citizen? Pretty simple question that Obama refuses to answer. The "anti-military sedition" developing here is horse hockey and nonsense.

Oh? Did you read the sedition laws from the USC I posted? Don’t kid yourself that the talk going on here by some is “horse hockey and nonsense”. It is being taken very seriously outside FR by the military and others.

RS, you can try to cloak sedition by fomenting mutiny in the ranks with the mantle of defense of the Constitution (that’s just laughable), but in the end, that defense will go absolutely nowhere.

When is a civil lawsuit asking Obama to prove that he is qualified to be Commander in Chief sedition, which he refuses to do so? The problem here is Obama cannot or will not prove he is a legitimate office holder. And the only thing laughable is your posts.

The issue of her sanctions, maybe. But the Rhodes case and all the questions relating to Obama's birth certificate are dead as far as this matter is concerned.

I have to say, as an attorney, her behavior has been rather unacceptable, though. It would be one thing if she acted respectfully and dutifully filed suits she believed to be meritorious, but I believe she’s gone on record criticizing the judges and the like who rule against her. You just don’t do that.

President Bush didn’t *APPOINT* judges, he *NOMINATED* them. In September 2001, when Land was *CONFIRMED*, the Senate was *CONTROLLED* by the Dems. You can *TALK* all you *WANT* about President Bush, but the *FACT* is the Dems *CHOSE* the judges at that time.

There is this really neat document out there called the "Constitution". It was written a long time ago, and while it doesn't have any pictures I think you might be able to get through it in a couple of hours. Anyway, there is this one part called "Article II, Section 2" that talks about what a President can do and in it is says the President "...shall nominate, and by and with the Advice and Consent of the Senate, shall appoint Ambassadors, other public Ministers and Consuls, Judges of the supreme Court, and all other Officers of the United States, whose Appointments are not herein otherwise provided for, and which shall be established by Law;"

You and Taitz ought to get married. Your minds seem to work in eerie parallel.

Orly has a much better chance with justice Carter. Carter seems like a reasonable man, who puts his politics aside.

Based on transcripts of the sessions held to date, it looks like Orly's trampled on a nerve or two. But that's not what's important. What is important is the fact that Orly's got until Monday to respond to the Defense's motion to dismiss and she hasn't done it yet. If she does not, then the Judge will make his decision based on the defense motion, Gary Kreeps' response to the motion, and the defense's reply to Kreep's reply which is due on the 21st. Orly will be on the sidelines until October 5th.

I admit that it's the judicial equivilent of a smack on the nose with a rolled up newspaper, but that was all that Hemenway's complaint deserved. The dumb bastard's 83 for God's sake. Should the judge have tossed him in jail for 10 years?

Actually I think we're all drawing amusement from watching Orly crash and burn. Again. And again. And again. And what's truly funny is no matter how many times Taitz screws up, no matter how many cases get dismissed, no matter how many errors she makes or how many judges laugh her sorry butt out of court, you and your buddies are right there saying, "Just wait. She'll win on the next one." It is absolutely full-blown, falling-down laughable. You're like the kid faced with a room full of horse manure and who starts digging saying he knows there's a pony in there somewhere.

Absolutely correct. Thank you for your posts.

It is amazing that almost no one will fight to uphold the Constitution.

It is clear to any one with common sense that Obama does not meet the requirements for being a NBC. If he was born in Mombasa then he is not even a US citizen at all.

And yet the only person to carry on the fight is Orly. And she gets pummeled by the right and the left.
