$10,000 Sanction Proposed Against “Birther” Lawyer (Orly Taitz)

Federal Judge Clay Land may have made good on his threat of sanctions against a lawyer for an army officer fighting deployment on the claim that President Barack Obama was not born in this country. In an order today Judge Land denied a motion for a Stay of Deployment for Captain Connie Rhodes, filed by Attorney Orly Taitz yesterday. The motion was filed after Judge Land threatened sanctions and dismissed the complaint calling it frivolous. Taitz has 14 days to show why a $10,000 penalty as a sanction should not be imposed against her. We tried reaching Taitz. She has not returned our calls.

In a bizarre twist, News 3 has received a copy of a letter to Judge Clay Land, written by the officer in this case, Captain Connie Rhodes. In it she writes she is shipping out to Iraq and asks the Judge to withdraw the Motion to Stay the Deployment. She denies authorizing Taitz to file on her behalf.

I might be a little irritable. It’s not been a good day, so I’ll just say...That’s what I am asking. It seems to me that mine was an all encompassing question that could be either answered or not.

No you don't. The California judge, Carter, is a Clinton appointee. But he's also a former Marine officer who got a bronze star and purple heart at Khe Shah.

I would like to hear others views on the post as well.

I hate having to grasp at the little strings of hope people dangle regarding this issue.

90% of my pessimist brain doesn’t want to even begin to hope that there might be some truth to the post.
We have been burned so many times in the past.

But a small piece of my heart felt good after reading it.

As always, we shall see. October will be here soon.

The source for this story is WRBL TV in Columbia, Georgia: “$10,000 Sanction Proposed Against ‘Birther’ Lawyer.” They have been asked about this letter and they are trying to track it down. More to come.


This is the point where I’m asking admin to put a question mark at the end of the title.

Hmmm ... you don't think its possible some Obot went to the OfficeMax in Columbus, GA, to fax a letter into the judge, and then the judge - who editorializes more in his orders than Maureen Dowd does in her columns - acted on the letter without checking to see if Capt Rhodes really sent it, do you?

That's not the point.

The point is that Sir Valentino posted two days ago on the thread I linked to in post #18 that Judge Land was a Clinton appointee, something that is not only wrong but can be quickly verified.

As it turns out, Judge Land, a former Republican State Senator from Georgia with a reputation as a solid conservative was appointed by George W. Bush and confirmed by Senate on 21, Sept. 2001, a time, you may recall, when GWB enjoyed enormous political capital to do as he wished.

After being set straight by multiple posters on the previous thread, Sir Valentino continues to disseminate incorrect information, a strategy that is not unusual among Birthers and one reason why so many of us cannot take them seriously. Intentionally spreading misinterpretations, imaginings, wishes, blatantly incorrect information, and outright fabrications as absolute fact and then repeating them over and over again until everyone believes them and no one questions them is a common tactic employed by Birthers on these many threads.

The truth is that the judge is correct about the Army officer’s refusal to deploy.

If nothing else, this is an ongoing war, authorized by Congress long before Obama took over. Besides that, her orders do not come from the president, but from the Chairman of the Joint Chiefs, an officer who has separately been approved by the US Senate.

At this point, even if she objected to Obama, her only evidence puts that objection at the level of personal philosophy, which doesn’t pass muster as an acceptable reason for refusing a lawful order in the manual of courts martial.

It sounds, though, like she might have seen the light. Besides, you don’t leave your mates in the breach when they go off to war.

I have applauded Dr. Taitz’ efforts to get the information on POTUS Obama made public so the congress would have to act. However, if she did indeed proceed on the CPT Rhodes case without CPT Rhodes permission...she should be sanctioned.....but NOT for filing “frivolous” suits...but for acting unprofessionally in this situation.

I understand Dr. Taitz’ exasperation....I feel it as well. However, maybe it is time she takes a few deep breaths as she steps back for awhile. I personnally think the concept behind her pursuit of the truth on POTUS Obama is correct, but I think her passion is getting the better of her professional judgement. I commend her for her pursuit; I believe her motives to be pure, but she is rapidly losing credibility by “show boating.” I’m concerned about her mental state. I am not saying she is wrong about POTUS Obama....just that I must concede she is starting to act irrational. Even though most in the legal profession disgust me with their IMO foolish procedures that hamper true pursuit of justice....it is their system and to continue to fight against it is not rational. She needs to be more professional in her deportment and procedures.

It’s an unprecedented situation in US law. But International Laws of War for a thousand years are based on St. Paul’s statement: “Obey the Powers that be, because the Powers that be are from God.” Usually that phrase was translated as “obey the magistrates” or “obey the duly constituted authorities,” whether Emperor, King, Duke, or President.

But theologians and legal philosophers all agree that the legitimacy of a soldier derives from the legitimacy of the magistrate.

I’m not talking about “international law” as it is made in the Hague. I’m talking about accepted international law and Natural Law as it was recognized by the Founding Fathers.

But this is, certainly, unprecedented in America, since we have not previously suffered from a POTUS of questionable legitimacy or a president who might justly be called a tyrant.

For the record, there is historical precedent. President Chester A. Arthur was accused of not being a natural born citizen and of being born in Canada. Arthur’s father was born in Ireland, immigrated to Canada and then crossed the Canadian border to live in Vermont. Arthur’s mother was a natural born American citizen and his father became naturalized.
But in the parlance of the 21st Century, the 21st President might have been an “anchor baby.”

Here’s Clay Land’s bio from when he was a conservative Republican Georgia State Senator prior to being appointed to the federal judiciary by President George W. Bush.

Clay Land, a Columbus Republican, was elected to the Senate from west Georgia’s 16th District (which includes north Columbus, Harris, Talbot and Marion counties) in 1994.

Land is a member of the influential Appropriations and Judiciary Committees. He also serves on the Natural Resources and Reapportionment committees. He has also served as a member of the Georgia Future Communities Commission, the Senate Structured Sentencing Commission, the Child Support Review Commission, the Election Code Revision Committee, the Senate Study Committee on Privatization of Governmental Services, the Senate Study Committee on Foster Care and Adoption, and as chairman of the Senate Study Committee on Civil Justice Reform. Land has been recognized for his legislative contributions by various organizations, including the Outstanding Legislator Award from the Georgia Council on Aging, a Legislative Appreciation Award from the Georgia Municipal Association, and the Legislative Award from the Georgia Gerontology Society.

Congress is in charge of the REGULATION of the Army.

If they approve a CJCS, then his orders have the force of Congressional regulation behind them regardless of who is president.

The CJCS issues deployment orders.

What professional judgment? Looks like someone at least gave the client some good legal advice late in the game. Probably an on-base civilian attorney adviser.
