San Joaquin Valley Water Users File Suit Over Water Restrictions

Federal Actions To Protect Salmon Based On Flawed Science

BAKERSFIELD, Calif., Aug. 28 /PRNewswire/ — The Coalition for a Sustainable Delta (Coalition) and the Kern County Water Agency jointly filed suit against the United States Department of Commerce, National Marine Fisheries Service (NMFS) for their continued failure to address all factors or stressors that impact the Delta ecosystem and its fish species. The suit focuses on recent federal actions, designed to protect salmon populations, which will bring great harm to California’s economy and ongoing water crisis, but provide little help to the ecosystem or its fisheries.

The water pumping restrictions contained in the revised NMFS salmon biological opinion (BiOp) will further reduce water supplies for 25 million Californians, millions of acres of farmland and countless businesses throughout the state.

“Federal regulators are layering bad decisions on bad decisions and exacerbating California’s water crisis. Residents, farmers, farm workers and our economy are already paying a high price for the inability of federal regulators to address the real problems regarding a declining Delta ecosystem,” said Jim Beck, Kern County Water Agency General Manager. “The salmon BiOp adds to the problem without providing any real solutions.”

Federal regulators continue to focus their attention only on the water projects and continue to ignore the effects of other stressors on the Delta and its native fish species. The suit focuses on three main issues:

Failure to use the best available science and data;
Failure to properly analyze the effects of all stressors on listed species; and
Failure of federal agencies to demonstrate the benefit to the listed species from further pumping restrictions.

The overall health of the Delta ecosystem, including the health of salmon and green sturgeon, is in decline due to a number of stressors. Among the well known factors contributing to the decline are contaminated run-off; pesticide discharges; predation from striped bass, black bass and other non-native species; widespread pollution from wastewater treatment plants; development of levees; dredging; operation and expansion of shipping channels; and land-use activities.

“We cannot allow federal bureaucrats to continue destroying our economy based on bad science and untested theories. By again focusing only on water pumping and failing to address all the Delta stressors, our economy will be further damaged, businesses and workers will unnecessarily suffer, and the Delta ecosystem and fish populations will continue to decline,” said Michael Boccadoro, a spokesperson for the Coalition.

The Coalition for a Sustainable Delta (Coalition) is an ad hoc group of water users who depend on conveyance through the Delta for a large portion of their water supplies. The Coalition is dedicated to protecting the Delta and is committed to promoting a strategy to ensure its sustainability.

The Kern County Water Agency (Agency) was created in 1961 by a special act of the State Legislature and serves as the local contracting entity for the State Water Project. The Agency participates in a wide scope of management activities, including water quality, flood control and groundwater operations to preserve and enhance Kern County’s water supply—the main ingredient for a healthy economy.

So, you’re saying that most of them probably voted for Zero then? How really stupid. If true, they shouldn’t be surprised at what’s happening.

It’s different for the rest of us...the conservatives. We voted AGAINST Zero. We knew what he was all about. And now we will suffer the consequences of the stupidity of others. As usual, the many will suffer for the actions of the stupid few and the voting dead.

Absolutely, all of Southern California that gets water from Metropolitan Water District is on water rationing.

Don’t wash your car and shower with your neighbor!

It may lead to that...but practicing civil disobedience by taking the gates and pumps that pump your own water puts them on notice and the ball in their court. They would have to escalate it to that...not us...and then the balloons go up on their account.

In addition, just my advise...but I would be very careful about posting direct bloodshed advise on an open forum like FR.

Save that for people you trust with your life, and where you know your comms are secure...because with these types of folks in power now, that is exactly waht it will mean.

I’m thinking that there is, in reality, plenty of water to go around for Americans, just like there is plenty of oil. Naturally, the leftists are lying about both resources.

But perhaps Zero and his commie cohorts plan to ship off a good part of American water to his Muslime buds in those not-so-irrigated countries. Makes you wonder.

Hello?? Hello? Anyone home? Those folks aren’t suffering from a water shortage. The federal government is not allowing them to use the water they have because it believes a fish is more important than their livelihoods. Read the story. Watch the video. All the desalinated water in the world won’t help them if the government won’t let them use it to farm.

They are still democrats, like most farmers which is a hangover from the depression.

I wouldn’t say they voted for obama but I would guess that most of the farm workers voted for obama and there ar a lot of farm workers for every farmer.

Most of thew farms in the valley are over 10,000 acres and many 100,000 or more.

I personally know 2 that farm over 100,000 acres.

Well, I can’t imagine someone considering themself a Democrat and NOT voting Democrat. I just wonder what they were thinking. Did they NOT know which party is the one that pushes this enviro wacko bs?

Living in this crappy state it amazes me I went shopping yesterday the Tomatoes were from Canada AND Mexico, the cucumbers came from Mexico, EVERY BIT OF PRODUCE I LOOKED AT CAME FROM MEXICO OR CANADA? Why the heck are we letting the people of this country suffer!!!!!

This ticks me off big time. My friend was in this area and she said it was very sad what she saw.
Where is Farm Aid, where is the President paying attention to American Families, where is Pelosi, Boxer, Feinstein. Pelosi is so busy accusing people of being racist.
I LIVE IN CALIFORNIA ABOUT 1 HOUR AWAY FROM THESE FARMS I SHOULD NOT HAVE TO BUY FOOD FROM MEXICO, AND CANADA WHEN WE HAVE IT IN OUR BACKYARD.

FIND A WAY TO TURN YOUR WATER ON THEN STAND VIGIL BY THE THOUSANDS AND KEEP IT ON.

Exactly right!

One more thing, all what these pump need to protect the f*g fish is a screen or a cage around the suction pipe(s). Any contractor can put a stainless mesh deep in the soil and higher than the highest possible water level around the pump suction inlet piping, et voila!

The only thing is that environmental whackos don't want a solution; they want control, pure and simple.

I have other non-engineering suggestions that couldn't be put in writing.

Same thought came to my mind - there are thousands of people directly affected by this. Do some disobedience and turn those valves on. I doubt the governator would send the National Guard to stop them (heck the Guard would probably help).

If they did send the guard we could still whip their a**!
