There has got to be more to this story than is being reported. If he was posting the flyers on private or public property without the consent of the owners or the city then the guy broke the law and is wrong.
Also, are the pro-Obama murals painted on private property with the consent of the owners? If so, there isn’t a legal problem with the murals. Private property owners have the right to “discriminate” and allow only certain signs/murals posted on their property.
However, if the pro-obama murals were allowed to be done on public property, but the anti-obama flyers were not, then the guy should sue.
Unfortunately, I can’t judge without knowing more of this story.

Exactly right on all counts. We are not getting the full story.
What I do know is that posting bills like those on public property is expressly against the law in Houston. It is true that it is intermittently enforced, but the law is enforced on occasions.
It also sounds like he was not just taping the posters up, but using some sort of glue to post them so that they would be permanently attached...most people looking for their lost pets don't use glue to attach their signs.
Judgment reserved until further information becomes available.

Actually it could still be illegal under Houston statutes which dicatate everything from mandating drab gray/brown porno bookstores (can't have a colorful mural even non-sexual) to no "billboard" or offsite advertising on the side of your business. This Obama mural probably violates the billboard ordinances of Houston.
