James O'Keefe's foray into filmmaking may cost him a few years in the slammer.
O'Keefe and fellow conservative activist/budding investigative journalist Hannah Giles were the ones who dressed up like a pimp and a prostitute, respectively (or not), and went to the offices of the Association of Community Organizers for Reform Now (ACORN) in D.C. and Baltimore looking for advice on how to buy a house.
The resulting video caused quite a commotion and resulted in the firing of four ACORN employees, as well as other repercussions for those who support the organization.
In Maryland, it's against the law to tape a person without their prior permission. It's also illegal to "willfully use or willfully disclose the content of said audio," Baltimore City State Attorney Patricia Jessamy said in a statement released late Friday.
She added: "The penalty for the unlawful interception, disclosure or use of it is a felony punishable up to five years."
The Baltimore City State Attorney's Office is investigating the matter.
I am sure there are no video cameras in the banks, convenience stores and grocery stores of Baltimore.
Does 60 minutes still do the hidden camera thingy? I don’t know ‘cuz I haven’t wasted my time on them in decades ;’}
The sound portion is the focus of the law. Security cameras typically record silent video.
No, the most important thing is to punish such injustice perpetrated under the color of law!
They are white and there would be an all-black jury probably in Baltimore. SO yes, the prosecutor will definitely race-bait.
I’m afraid that the only thing that kept Tripp out of jail was tainted testimony from Lewinsky and the interference of the Independent Counsel. This is a real threat to these kids. Sickening isn’t it. The first thing a corrupt government does is erect barriers to their own exposure and prosecution.
Apparently the DA didn’t see anything wrong done by ACORN in the video. I’ll bet you anything the DA is a “friend of ACORN” like my mayor here in Irving TX.
Defense could argue that an “all black” jury is not a jury of peers. One or more white people, and nullification could well hang the jury.
What, Me Worry?
If news stings are exempted (we don’t know yet) that would be something for the jury to sort out, whether this is a news sting.
Like an episode from “The Wire.” The Baltimore Way: stupidity, incompetence, and corruption against a backdrop of racial grievance politics. One of those places—like Gary and Detroit—where the quality of life has experienced a dramatic downward spiral after decades of Liberal rule.
Tax evasion, illegal immigration and child prostitution are apparently no big deal in that neighborhood.
Let us not allow the left to decide what the news media is and is not.
I agree that we live in scary times.
However, prosecution is not mandatory.
There is room, legal room, for discretion on the part of the prosecutor.
The black democrat prosecutor and open supporter of Obama?
Are you kidding?
This is the procedural way. A bench trial might offer better odds.
And Obama would be smart to ask her NOT to prosecute!
If Maryland pursues that course, the prosecutor should explain why he or she didn’t do the job our young journalists did for them. ACORN is a criminal organization that is helping to destroy our Democratic system and our culture, while scamming tax payers out of billions of dollars . RICO!
