Send Obama's Email Spammers an OPT-OUT Request

Fox identified the private company responsible for sending the spam email from Axelrod and Obama. They are called GovDelivery.com

I sent the spam firm an email requesting to opt out of their distribution lists. I don't know if that will work or not. Does the Do Not Call rule apply to email spammers?

Government communication and technology leaders are extremely optimistic about the effects the Web-savvy Obama team could have on the use of social media. Teresa Nasif, director of GSA's Federal Citizen Information Center, says her interactions with the transition team have convinced her it is committed to services, citizen engagement and transparency. "We just think that everything we've been working on over the last few years is going to be expanded and accentuated under the new administration," Nasif says.

Many are hopeful that the Obama administration's pro-new media attitude and familiarity will bring policy changes. Scott Burns, chief executive officer of GovDelivery, a St. Paul, Minn.-based firm providing software and services for government-to-citizen communication, says he expects security and privacy rules to be updated so agencies can take advantage of free offerings such as YouTube and Google maps. "It's very clear that they'll be engaged in updating some of the rules and regulations so the federal Web managers, who are clamoring to use these tools, will be able to use them more easily," he says.

Rule changes certainly would ease agencies' ability to use social media, but Godwin believes a firm go-ahead from the top would spur things along: "We really hope . . . the White House from its bully pulpit says, 'This is OK,' and gives agencies the comfort level to make that leap of faith."

I have never seen anything even remotely like this administration.

Asking does this or that rule apply is useless.

Obama and his White House are rouges. They do not care about rules or laws or the American people at all.

They do whatever they want whenever they want with no regard for consequences.

They are out of control.

We have a rouge government.

Well that article is certainly a diversionary article of the main point. IT WAS UNCONSTITUTIONAL AND ILLEGAL OF OBAMA TO ‘HIRE’ THE FIRM WITH OUR TAX DOLLARS.!!

They send out solicitations for donations for various organizations — their email must be huge and explains why all of a sudden I received an email from the DCCC

This organization is involved in sending out what I would call spam for a host or organizations. Looks like they may have been behind all the crap sent out by the Obama Administration asking for donations. Someone said on a site Obama hooked up with them in 2004 but I cannot find independent confirmation only someone’s comment.

I have websites that come up in google search that are no longer there.

This group cut a deal with the Department of Treasury to handle correspondence in 2007 after Paulson was named the Treasury Secretary in the summer of 2006. It looks like until Paulson was named, there was no push for GovDelivery.com to handle federal correspondence that I can find. If they do go back to 2004 with Obama it lends credibility to the fact the Dems controlled Paulson and he undercut McCain for Obama which IMO is true:

I don’t know how all of this is going to end. Right now, it does not look good.

Just the precedences that are being are amazing.

When the people responsible for making and enforcing order start parading around with a cigarette in their mouth yelling “shut the f*** up!” The law applies to you, not to me!

Well, then America is lost.

Sorry sweetheart, I am not normally this gloomy, but damn, watching my country being ripped to shreds by someone who we don’t even know who he is or where he is from, hurts. It is Biblical.

It hurts a lot and why I brought my blog back to life, http://DemocratsforSale.blogspot.com and why I am now working on a website so that opposition research on Dem candidates can be put on line for the world to see how corrupt this bunch of Dems are and how they lie and charge Republicans are doing something when, in fact, they are behind the mess.

Was getting ready to post this information about and couldn’t get into the blog but my other two blogs had no problems.

This has made me even more irritated so I will be researching into more about GovDelivery.com — the pieces fit of why I received SPAM email from the DCCC when I have been been on their site. I am sure I am in some poliltical email database that these turkeys have in their possession.

The man in the WH is nothing but a fraud and a puppet of people who want to destroy this Country.

I don’t know the relevant statutes, but my company is NOT allowed to send out any emails to our customers unless they specifically allow it.

Our opt-in policy is required by a new federal privacy law that could cause us to be fined upon complaint.

This includes me sending out emails on pricing, new products and company info.

This appears to be a blatant disregard for their own federal rules.

That post you were referring to was in regards to the “Do Not Call” list ... and it has nothing to do with e-mail... :-)

The CAN-SPAM Act: Requirements for Commercial Emailers

The CAN-SPAM Act of 2003 (Controlling the Assault of Non-Solicited Pornography and Marketing Act) establishes requirements for those who send commercial email, spells out penalties for spammers and companies whose products are advertised in spam if they violate the law, and gives consumers the right to ask emailers to stop spamming them.

The law, which became effective January 1, 2004, covers email whose primary purpose is advertising or promoting a commercial product or service, including content on a Web site. A “transactional or relationship message” – email that facilitates an agreed-upon transaction or updates a customer in an existing business relationship – may not contain false or misleading routing information, but otherwise is exempt from most provisions of the CAN-SPAM Act.

The Federal Trade Commission (FTC), the nation’s consumer protection agency, is authorized to enforce the CAN-SPAM Act. CAN-SPAM also gives the Department of Justice (DOJ) the authority to enforce its criminal sanctions. Other federal and state agencies can enforce the law against organizations under their jurisdiction, and companies that provide Internet access may sue violators, as well.

And in terms of “opt-out” or “opt-in” ... you can see the following...


It requires that your email give recipients an opt-out method. You must provide a return email address or another Internet-based response mechanism that allows a recipient to ask you not to send future email messages to that email address, and you must honor the requests. You may create a “menu” of choices to allow a recipient to opt out of certain types of messages, but you must include the option to end any commercial messages from the sender.

Any opt-out mechanism you offer must be able to process opt-out requests for at least 30 days after you send your commercial email. When you receive an opt-out request, the law gives you 10 business days to stop sending email to the requestor’s email address. You cannot help another entity send email to that address, or have another entity send email on your behalf to that address. Finally, it’s illegal for you to sell or transfer the email addresses of people who choose not to receive your email, even in the form of a mailing list, unless you transfer the addresses so another entity can comply with the law.


Your own company may have better rules to operate under than what is required by this particular law, and that would be good, but all of your own company’s policies for e-mail wouldn’t necessarily have to be followed by all other companies and/or e-mailers...

A year after a sweeping federal antispam law went into effect, there is more junk e-mail on the Internet than ever, and Levon Gillespie, according to Microsoft, is one reason.

Lawyers for the company seemed well on the way to shutting down Mr. Gillespie last September after he agreed to meet them at a Starbucks in Los Angeles near the University of Southern California. There they served him a court summons and a lawsuit accusing him, his Web site and 50 unnamed customers of violating state and federal law - including the year-old federal Can Spam Act - by flooding Microsoft’s internal and customer e-mail networks with illegal spam, among other charges.

But that was the last the company saw of the young entrepreneur.

Mr. Gillespie, who operated a service that gives bulk advertisers off-shore shelter from the antispam crusade, did not show up last month for a court hearing in King County, Wash. The judge issued a default judgment against him in the amount of $1.4 million.

In a telephone interview yesterday from his home in Los Angeles, Mr. Gillespie, 21, said he was unaware of the judgment and that no one from Microsoft or the court had yet followed up. But he insisted that he had done nothing wrong and vowed that lawsuits would not stop him - nor any of the other players in the lucrative spam chain.
