Pre-abortion ultrasound law struck down

OKLAHOMA CITY, Aug. 19 (UPI) -- An Oklahoma judge struck down the state’s abortion law requiring ultrasounds, ruling it violated a requirement that legislation deal with a single subject.

Oklahoma County District Judge Vicki Robertson ruled the 2008 abortion law was a compilation of five separate bills, but did not address other legal complaints on the law Tuesday, The Oklahoman reported Wednesday.

The most controversial aspect of the law was a requirement that a doctor or medical technician performing an abortion give a pregnant woman an ultrasound before the procedure and display the images where the woman could see them, the Oklahoma City newspaper said. The law also required that the woman receive descriptions of the images, including whether the fetus’s heart were beating.

The bill’s author, Republican state Sen. Todd Lamb said he would “likely make a formal request” that the attorney general appeal the ruling.

“I don’t think it violates the single-subject rule,” Lamb said. “There are multiple provisions and sections of this legislation and the argument could be made that it’s pro-life all the way through.”

State Republican Rep. Pam Peterson, the law’s House sponsor, said she thought the judge “ruled on a technicality and not on the true substance of the bill.”

it’s one of the best ways to reduce abortion though tv ads are probably even more effective

So the unborn loses the chance of persuasion for its life due to a formality of legal procedure.

I believe that this would greatly reduce abortions as most women have to make the argument ( within themselves) that this isn’t a human being. When they are able to see that the child is “fearfully and wonderfully made” I believe that they would change their minds. Not all. But some. And that would be a huge leap forward for those of us who believe that life is a sacred gift from a Holy God.

This happens all the time in WA state. The judge rules an initiative violates this standard, then throws the whole bill out.

Isn’t it wonderful that the federal govt applies the commerce clause to multiple situations, then judges rule that THAT is a correct interpretation? Things written to specifically address multiple situations....BAD, things written to generally address multiple situations ....GOOD. I think the common denominator is they like things left open for interpretation, a kind of jobs program for libs and lawyers.

So, thousands of Oklahoma babies will be sliced, diced and hamburgerized but, at least the higher and truly sacred principle of no more than one subject being addressed per statute is maintained. “Rule of law” almighty/babies slaughtered/pro-abort business as usual.
