Relatives of the city's first swine flu fatality say they are ready to sue the city for $40 million.
Mitchell Wiener's widow Bonnie and his three sons, Adam, Jordan and Farrell, filed a notice of claim alleging the city was negligent in dealing with the outbreak that swept through the city three months ago.

It is reasonable to expect, based on data from the 1947, 1957, and 1968 pandemics that 60-75% of the human population will be infected within the next 18 months.
That is, 3.6 billion to 4.5 billion people - so if the mortality rate is a very low 0.5%, twenty million people will die.
Now, if failing to prevent H1N1 transmission becomes a reimbursable tort, we are going to run out of money pretty fast.
Greed, greed and more greed. Sorry for the loss of husband and father, but, this law suit is nothing more than pure greed for the family and the stupid lawyer that is filing the case. Judge should throw the case out.
It is called a cytokyne storm. It is when your immune system kills you, and it is frightening.
Like lawyers.

He was given an experimental drug:
“Mr. Wiener, 55, had been overwhelmed by the illness, despite beginning a course of treatment with an experimental drug, Ribavirin, after he failed to respond to other antiviral drugs, according to Ole Pedersen, a spokesman for Flushing Hospital Medical Center, where Mr. Wiener had been a patient since Wednesday.

Another “experiment”...he was administered a “special vaccination.” It had to experimental because they’re just now testing the vaccines.
“At Flushing Hospital Sunday night, Mary S. Meguerditchian, 60, whose husband has been recovering from a stroke on the same floor as Mr. Wiener, said the family had seemed optimistic about Mr. Wieners chances on Saturday. But on Sunday Ms. Wiener had told her that a special vaccination had been administered to Mr. Wiener, but it didnt work, Ms. Meguerditchian said.”

Indeed, we can't discuss tort reform while we're supposed to be having a debate about healthcare reform. This family is suing for what is no longer a reportable disease, and it's now being treated just like seasonal flu.
Making thing worse, this administration had plans for involuntary internment and quarantine for failure to comply with involuntary vaccinations, among other things. IIRC, the gathering of the safety and efficacy of these vaccines made by five different companies is still a work in progress.
Fortunately, a federal district court in NJ has issued a preliminary injunction against involuntary swine flu vaccinations.
