After being dismissed in Georgia and refiled in the United States District Court for the Middle District of Florida, Judge Richard A. Lazzara quickly dismissed the claim of Major Stephan Cook against various defendants, including President Barack Obama.
The ground for dismissal without prejudice given by the court is lack of jurisdiction.
The order was signed on July 27, 2009. Apparently, since the allegations of the Florida claim are grounded on Federal statutes against employment discrimination, such a claim must be presented first before the Equal Employment Opportunities Commission for resolution.
Maj. Cook’s original claim contesting the validity of his orders to deploy to Afghanistan rested on the alleged lack of authority of the President as Commander-in-Chief due to uncertainty about Mr. Obama’s United States’ citizenship.
That claim became moot when his orders to deploy were revoked, and the case was dismissed. However, Maj. Cook was subsequently dismissed from his employment with Simtech, Inc., a private company working under contract with the Department of Defense. In his Florida claim, he argued that his dismissal was due to pressure from the Defense Department.

U.S. District Judge David O. Carter ruled in favor of Taitz and granted the “motion for reconsideration of order to show cause or in the alternative to certify question for appeal.”. A trial date will be set and Taitz “will immediately request access to Obama’s birth records and other documentation that could determine his eligibility to occupy the Oval Office.”
No, I don't know if one has been set. I suppose the Judge is waiting for Obama's response.
He won't. Obama has had the opportunity for over a year to submit it to a court. If he did, Obama would open the window for the court to discover his long form COLB since Obama's COLB is a certification of the certificate that Hawaii has on file. Another reason it could be a forgery.

I have no doubt Obama's center piece for his defense will be Fukino's recent statement that he was born in Hawaii.
I've been formulating an argument for our side to impeach the government defense. It's Perry Mason like...or pretty dang good. It will place much uncertainty in believing the government's case in the mind of the judge...so the case can move forward to discovery. I have to check on a couple of facts. I should have it written up by this weekend. I may do a thread on it.

The way around the COLB statment will be the argunment about the AMENDMENTS in Obama’s file. Because those are what’s gonna tell the tale. If he was registered late, its an amended file. If he was adopted, Amended file again. If he was born in a “house” setting, then that is NOT porrf he was morn in the island, all of those things could easily indicate he was ont born on the island. You might not be able to prove he was born somewhere else, but at the same time, Obama can’t prove that he WAS either!

I did some digging. Now I don’t know how reliable the source, DEFEND OUR FREEDOMS, is but this is what I found.

And from what I’ve read, Taitz hasn’t had the best luck in the world serving the U.S. Attorney and/or Obama in the past.
Also....I will bet my entire 401K that there is not even ONE person in the entire history of the U.S. that has the words “natural born” anywhere on any birth document ever issued since the signing of the Constitution!
None of the “vital records” that Fukimo is referencing says any such thing as “natural born”!
Every word this woman has said about Obama’s records from the very beginning **stinks** of obfuscation!
If Fukimo wanted to be plain ( and she does NOT want to be plain), she would have said, “I saw Obama’s long form birth certificate, and the form states that he was born in ( name the city), Hawaii!”
She would not have said “natural born” because none of Obama’s “vital records” say any such thing unless Obama, himself, put the words “natural born” on these so-called records.
