The Federal Bureau of Alcohol, Tobacco, Firearms and Explosives has published open letters to federal firearms license holders in Montana and Tennessee explaining that federal law trumps state law when it comes to gun laws.

While the ATF is citing federal law they should also cite Article 1 Section 8 of the Constitution that lists all the powers granted to Congress by the Constitution. No where in Article 1 Section 8 is it listed that Congress has the power to create a federal police force including the ATF. The ATF is unconstitutional.

Well Sotomajor says according to the article that Fed gun laws do not apply to the States. How can the BATF claim they do? Either they do or they do not.
