Am I not mistaken or were the laws written specifically to include only native firearms sold to resident citizens thus making the commerce clause moot? Without commerce the feds should have NO jurisdiction in the matter.

The states are already ganging up on the fed and the pen should be the weapon of choice to be used in the USSC argument.Remember the states created the national government for a more perfect union.It has become far from perfect and more like a national dictatorship run via control freaks.

The Federal Bureau of Alcohol, Tobacco, Firearms and Explosives has published open letters to federal firearms license holders in Montana and Tennessee explaining that federal law trumps state law when it comes to gun laws.

Federal law does trump state laws on gun regulations. Too bad the feds don't read the Constitution.

If politicians don't read their own bills, who expects law enforcement to read the laws?

They can come and get my guns any time. Unfortunately, I was out in my canoe on lake Pend O’reille with all my guns and the canoe capsized in the deepest part of the lake; like 1100 feet deep. I lost every single one of them. Darn!

Wow! Me too... only.. no wait, my guns were all stolen by ACORN burglars during the election...

The states should get together and vote the Federal government out of existence and replace it with a VERY LIMITED administrative organ with NO legislative or executive authority. Let the administrator report to a national congress of state governors...

Wickard v Filburn : Farmer grows grain for his own livestock; was deemed subject to regulation thereof as commodity grain was indistinguishable from what commonly moves in interstate commerce.

Raich : Terminally ill elderly woman grew pot for own medical use under doctor's supervision as allowed by CA law; was deemed subject to regulation* thereof as reducing demand in an illegal interstate market.

Stewart : Convicted felon makes homemade machinegun, impossible to legally move in interstate commerce (can neither buy nor sell); was deemed subject to regulation* per Raich verdict.

Ergo, the commerce clause is moot. These states may declare portions of their intra-state arms market not subject to federal regulation, but Wickard established the "fungible" principle despite obvious non-interstate use, Raich applied it despite state legality, and Stewart applied it to firearms. These states are trying to forge a path in already-paved territory.

(* - to wit: prohibition)
