A Lutz Army reservist who claims he was fired from his job after fighting his deployment to Afghanistan on the grounds President Barack Obama is not an American citizen is asking a federal judge here to order his former employer to rehire him.
A federal judge in Georgia dismissed a petition by Stefan Frederick Cook earlier this month after the Army revoked Cook's deployment orders. Cook's motion had sought an injunction preventing his deployment.
Cook says in his Tampa complaint that his private employer, military contractor Simtech Corp. of Odessa, was pressured by the Department of Defense to fire him after he went public with his claims against the president.
According to Cook's resume, he worked for Simtech as a senior systems architect from 2007 until earlier this month.

If I can be honest, I don’t give a crap about this guy. When President Bush called our armed forces to war in Afghanistan and Iraq, the people refusing to go were cowards, deserters, the worst type of traitor. I’ll lay a few bucks that his refusal to deploy has nothing to do with citizenship or otherwise, it’s pure and simple cowardice. I could be wrong but I really don’t think so. When you sign on as a reservist, you don’t have a proviso at the bottom that says “But if I don’t like the president or if he’s marxist or leftist I don’t have to listen to him.”
Cook's Tampa filing includes attachments that purport to discredit Obama's birth certificate as fraudulent...The complaint also asserts that "Barack Hussein Obama might have used as many as 149 addresses and 39 Social Security numbers prior to assuming the office of president."
Simply, Unlawful Termination legal action can be taken, but it will take YEARS to get through the Courts, which are packed with Activist Liberals.

An officer is not obligated to follow an illegitimate order. If the Pres__ent is not eligible to be CIC the orders are illegitimate. And Cook is not a coward. He has been in cobat and went into the reserves.
While all that may be true, there are also laws that prevent employers from firing Reservists over deployment issues.
he circumstances are not similar. In the first case they just didn’t want to go and made the lame excuse the Bush was this or that or the war was illegal. No one to my knowledge ever took their case to court and proved their position. In Cook’s case he’s saying this president is not a natural born citizen and hence can;t be pres. He’s willing to take his case to court and have it tried on the evidence. See the diff?

"Being a whackadoodle" is a good way to lose your clearance. It's easy for the DoD to make that determination when a clearance-holder publishes the evidence of his whackadoodlery in a lawsuit.

His employer is a DOD service provider. The DOD contract allows the Government to reject any employee assigned to the contract, with little or no justification.
It stinks for him,but thems the rules.
If he can convince a judge that he is a “whistle blower” he may have a “retaliation” case against the DOD.

He was fired for refusing to deploy when told to do so.
