Gut shots claimed Oklahoma City pharmacy robber (Mr. Ersland- OK)

The robber killed by a pharmacist in May died from gunshots to his body, not the shot to his head, the state chief medical examiner confirmed in the autopsy report.

Antwun Rayshaun Parker, 16, of Oklahoma City was knocked out after being shot in the head and would have survived that injury, Dr. Collie Trant told The Oklahoman.

Pharmacist Jerome Jay Ersland is charged with first-degree murder in a case that sparked a national debate. Prosecutors allege he went too far because he shot the robber five more times after knocking the robber unconscious with the shot to the head. Ersland said he acted in self-defense. He said in a nationally televised interview that he thought the robber was getting up.

The autopsy report released Tuesday describes the first wound as a "non-fatal gunshot entrance/graze wound to head.”

Trant explained the first shot involved a three-pellet shell.

Parker was shot five other times — to the chest and abdomen, the autopsy report shows.

However, the perp made a movement while on the ground. Based on his past behavior (of the previous two minutes wherein he threatened to kill the pharmacist) all bets were off.

Pharmacist: not guilty.

The following is a matter of opinion, not a matter of law. If called upon to serve on a jury in such a case, I would seek to find accordingly. I quote myself from an earlier thread about this case:

If it is true that from a legal standpoint, he is guilty of murder, it is time to change the law, whether by appropriate legislation or (more likely) jury nullification.

IMHO, if someone comes at you with a weapon, whether he discharges it or slashes at you with it (depending on weapon type) or not, you have every right to be certain in your own mind that the individual has completely stopped being a threat to you.

If that certainty requires that you burn through 58 rounds in assorted calibers, so be it.

IMHO if you go into someone’s home or place of business threatening deadly force for any purpose whatever, you forfeit any right you might have had to leave that place alive.

If it takes the homeowner or other defender two or three tries to finish the job, than— sucks to be you. Should have gone someplace else.

Conversely, if the homeowner or whoever takes pains to keep you alive and hand you over to authorities, then you owe your life to that individual along with restitution for any loss or damage to him. The appropriate response is gratitude and an overwhelming sense of obligation.

Considering the head wound was just a graze, that's quite possible.

I was out of the country at the time, but I seem to recall something about Sotomayor during her hearings saying something like she was not aware of any constitutional right to self defense.

Make it three. I think being gut-shot is most appropiate for robbers. “Job well done” to the shooter.

As Bernard Goetz learned on a NY city subway, once your attacker is down and out, you cant keep shooting him. I don’t have a problem with that. However, if he is still moving and in possession of a gun, he is still a threat and can be dealt with until the threat ends.

Does that count include all rounds expended, or just the hits?

A person in fear for their life will naturally empty the gun. It's actually a defense.

Except that's not what happened here. the videos clearly show the druggist shooting the punk then chasing the other thug out into the street after the first one went down. The druggist then came back in, went to the counter, switched guns, walked to where the punk was lying, stood over him and shot him multiple times.

That is homicide in every state in the union. The DA had to indict or else he was not doing his job. A jury will decide innocence or guilt according to the law.

I've told my wife to keep shooting until she is out of bullets. We practice this regularly and she usually carries an extra clip for her 9mm. She's a damned good shot, too. Woe be unto the fool who messes with her......

The first shot was from the judge then the druggist “upgraded” to a .380 auto. The question is if the Judge is so good, why the change to the pistol?

Had the druggist continued with the .410 cartridges, the coroner would never know which shots where the deciding factor.

The video shows the two perps entering the store and the druggist firing a single shot from the .410 revolver. I don’t recall if any robbers fired at this time. The druggist then chases the second perp out the door bypassing the first perp who is no longer in camera range.

The druggist then re-enters the store bypassing the area where the first perp was shot. The druggist then goes into a locked drawer and removes a .380, walks toward the first guy and fires five shots.

Texas CCW instructors teach their students to shoot until the threat is over.

The word phrase CCW instructors use is to "shoot until the threat is over". I put that in quotation marks for a reason.
