The Major says: "[Then] any order coming out of the presidency or his chain of command is illegal. Should I deploy, I would essentially be following an illegal [order]. If I happened to be captured by the enemy in a foreign land, I would not be privy to the Geneva Convention protections," he said.

What other of our brave military men and women will be seeking the same revoke of orders?

With the new engagement policies in Afghanistan, we might see a lot more of this.

This is a stupid headline. What is so "shocking".

This officer's career is over and he'll either face multiple articles of UCMJ like #'s relating to

like article 88, 117, or conduct unbecoming...or just be allowed to resign his commission if they don't want a show "trial".

I'm glad he 'won'. Yet, I am a bit concerned that it was so easy...something's not right.

Or, did he actually do what everyone else was afraid to do and that's why it was so easy?

They revoked the order because that would make a legal challenge “moot” and therefore would not be heard by any court.

The orders were revoked to moot the case and deprive Major Cook of standing to sue. However, there might be a way for him to keep the case going. Anybody who's ever been in the military knows that all personnel are at the mercy of orders that can send them anywhere, anytime. Those which are revoked can be reinstated and those which are reinstated can be revoked. The revocation of the orders itself gives no reason(s) for the action; full discovery is essential to see why it was done and what assurance Major Cook has, if any, that the orders won't be reinstated as soon as the suit is dismissed as allegedly moot. Thus, Major Cook could argue the case is not moot and he still has standing because his orders can be reinstated any time DOD decides to reinstate them unless there is further clarification of the reasons for their rescission and the circumstances of their possible reinstatement.

Another point is that this action by DOD opens the floodgates for every other military and naval person who wants not to serve in any location to raise the same objection and pressure DOD into rescinding his or her orders, an unacceptable situation that can only be resolved by allowing the case to go forward.

How do we reconcile this action with the objectors who refused their duty claiming that Bush was selected-not-elected, or that Iraq was an illegal war? Peter Brown, Ehren Watada, etc

Or maybe the Army just doesn’t want this guy commanding troops in the field. I sure wouldn’t want him as my commanding officer under the circumstances.

I hope road dog and zer0 have their day in front of a fair judge. zer0 should have to produce a real birth certificate, not a certificate of live birth.

The Major is going to need some money for this fight.

Excellent point about the Geneva Conventions.

I can’t see how this officer could be court-martialed without the opportunity to have Obama’s long-form birth certificate reviewed, by the court or otherwise.

Sounds like Obamas’s people thought of this too.

The fact that action was taken to make this lawsuit moot is very telling.

We may be in worse trouble than even I thought. I am hoping that somnehow this whole mess gets resolved soon - no matter how remote the chance.
