The Supreme Court ruled today that white firefighters in New Haven, Conn., were unfairly denied promotions because of their race, reversing a decision that high court nominee Sonia Sotomayor endorsed as an appeals court judge.
New Haven was wrong to scrap a promotion exam because no African-Americans and only two Hispanic firefighters were likely to be made lieutenants or captains based on the results, the court said today in a 5-4 decision. The city said that it had acted to avoid a lawsuit from minorities.
The ruling could alter employment practices nationwide and make it harder to prove discrimination when there is no evidence it was intentional.
“Fear of litigation alone cannot justify an employer’s reliance on race to the detriment of individuals who passed the examinations and qualified for promotions,” Justice Anthony Kennedy said in his opinion for the court. He was joined by Chief Justice John Roberts and Justices Samuel Alito, Antonin Scalia and Clarence Thomas.

The more I see Sotomayor and read her writings, the more I am convinced that she is not a smart person.
Well, Sotomayor has the richness of her experience. Not sure what she means by that, but that’s what she said.
I wonder what some digging into her background would find. For example, did she get into Princeton based on affirmative action, rather than her own academic credentials? I heard something about her being part of protests while in college regarding affirmative action policies.
And, does she have a worldview that all minorities are permanently crippled, due to discrimination that happened before people were born? Think about it — no black students under about age 50 attended a legally segregated school. Most minority college applicants in the past 40 years had the benefit of affirmative action policies in evaluating their college applications. The same is true of many jobs in corporate America, education, and the government.
I am happy about this Supreme Court ruling. I wonder what Sonya will say when questioned in her hearings. I doubt her nomination can be blocked, but it will be educational for America to put her on the hot seat. Remember how shamelessly Democrats put Judge Alito and Judge Roberts on the hot seat? Not to mention nomination battles of the past such as Clarence Thomas and Robert Bork.

She’s as rich as six foot up a bulls butt IMO. I am glad the USSC found for the firefighters who scored highest in testing for the jobs they sought.

There is an opening now for Republicans to question her about reverse discrimination.
