Well... I kinda predicted this.. I mean 4 were going to go for overturning and I expected Kennedy to do so as well... should make Sotomayor’s hearings more interesting though if the GOP members of the judiciary committee actually do their job
anyways, knowing the tyrant in the white house, I half expect him to try to impeach Scalia, Thomas, Roberts, Alito and Kennedy so he can replace them with judges “with empathy”... he would fail miserably of course but nothing Obamarxssiah does these days suprises me anymore

It is not going to change the makeup of the court. It will still be 4-4 with Kennedy deciding.

Sotomayor should not be confirmed.
To: Abathar
It’s an interesting case though.
The city threw out the exam results because they were afraid of a lawsuit resulting from poor performance by black candidates.
That’s so white.

her decisions are overturned by SCOTUS 60% of the timePermit me to boil this down for those who voted for Zero and are beginning to suffer buyer's remorse: Your candidate has nominated to the highest court in the land a judge whose record would have been better if she had flipped a coin to make her rulings.
Good job!

Thank you for posting the Summary. There are some gems in that dry language. Here's my favorite:
"Fear of litigation alone cannot justify the Citys reliance on race to the detriment of individuals who passed the examinations and qualified for promotions."

I recall reading that something over 50% of her rulings have been overturned..?
If correct, that alone should be enough to bar her appointment

“Were one vote away from anarchy. Im not seeing any cause for celebration either.”
Kennedy is no idiot. He knows what is happening out there and in light of that, his decision was the correct one.
Discrimination is a two way street and if anything, this hurt the RATS and especially Obama tremendously. Think of all the lawsuits, organizations like ACORN and the ACLU will now have to end off. If anything, this is opportunity to go at them with everything we have.
Today, after 40 years, the playing field has been leveled.

Dammit, those five white men (including that Uncle Thomas) did her wrong! Now she has to go to the International Court in The Hague to get confirmed. /s (just in case no one hears the sarcasm ringing from my fingertips.)

The slim majority on the Supreme Court sided with the Fourteen Amendment. Yes, it was a slap to Sotomayor who may have a law degree from Yale Law School and who may be a federal appeals court judge but has not learned to apply the law. She chooses to apply her emotions. Perhaps all Supreme Court nominees need to be tested to ensure their intellects can suppress their limbic systems.
I am disappointed in Fox News. Fox was focused on Bernie Madoff's sentencing hearing which really is only of cursory interest to the average person. The damage to the economy has already been done. The financial losses to other greedy individuals who should have applied "caveat emptor" to their investments does not really interest me. By comparison, the Supreme Court ruling in Ricci v. New Haven affects everyone in the United States!

Im appalled that it was 5-4. WHY? after 8 years of Clinton and slime like Souter slipping in under RINO Bush 41’s 4 years you get what you get.
Now with 4 years again of the 0bamanation...don't expect and improvements in the near future.
These Libs swear to defend the constitution, but you and I know they believe in some faux constitution...one that is ‘alive’ and based on the european ‘intellectual’ model.
but with 60 or so Dhimmicrat senators and 5-6 Dhimmicrat wannabe RINO’s, I don't expect Sotomayor to fail...though I sure hope that the Republicans at least make a fight of it.

Another important aspect of the case that got little publicity is the promotional exams had been developed by a company that specializes in race neutral testing.
