Police: Man kills attempted carjacker in NE Houston

A man who is licensed to carry a concealed firearm shot a suspected auto burglar and carjacker who attacked him at an apartment complex earlier last weekend in northeast Houston, police said.

The case will be referred to a Harris County grand jury to determine whether charges should be filed against the shooter, Houston police said.

Investigators said the shooter, who has not been identified because no charges have been filed against him, shot Darryl Milton Franklin Jr., 37, after he and his wife saw Franklin breaking into cars at the complex in the 1100 block of Langwick about 6:15 a.m. Saturday, police said.

No other injuries were reported.

A car owner fatally shot a man who was breaking into his car, police told KPRC Local 2.

Houston police said the car owner physically removed Darryl Milton Franklin from his car in the 1100 block of Langwick Drive on Saturday morning.

The car owner told Franklin to leave before he called police.

Investigators said Franklin left but tried to break into several other vehicles into the area. He tried to carjack a resident at the apartment complex, police said.

The first car owner called police and approached Franklin again, investigators said.

Franklin jumped on the car owner and the two got into a struggle, detectives said. The car owner's wife hit Franklin several times to try to get him off her husband.

The car owner, who has a concealed handgun license, pulled out a gun and shot Franklin in the chest, police said.

Detectives said the car owner and his wife called for medical assistance.

The case will be referred to a Harris County grand jury.

If I were the shooter I’d sue the “victim’s” family for emotional distress.

Unfortunately he’d probably lose his gun because he’d be ruled mentally unstable.

If this man is charged, I think that even a California jury would find him not guilty. He gave the carjacker ample time and opportunity to escape before pulling his weapon. He and his wife were physically attacked by the carjacker. Then they even attempted to resuscitate him. The shooter acted responsibly and with restraint.

There are no concealed weapons to speak of, here in Kalifornia. Carjackers, gang bangers, and gun grabbers like it that way. This noble citizen would get 20 years for his public service.

It seems to me that charges are warranted. The shooter APPROACHED the man and INSTIGATED a confrontation. They had already called police twice; there was no cause to escalate this to the point where the shooter placed himself in danger and then had a "reason" to defend himself. I'm sure many of you Wild West yahoos are applauding this man, but I see nothing heroic in this act of stupidity. If the gun had been taken from him and used to shoot him, then we'd all hear about how he was reckless in approaching a criminal, not knowing if he was armed or not. Bottom line. STUPID and worthy of an indictment. No "castle doctrine" applies here at all.
