It had all become too much. After three days spent fending off Senate Democrats' relentless badgering, including insinuations that he was racist, anti-woman and a liar, Samuel A. Alito Jr., President George W. Bush's nominee to the Supreme Court, was asked directly by Republican Sen. Lindsey Graham, South Carolina Republican, "Are you a bigot?" Justice Alito responded, "I'm not any kind of bigot."
It was then that Martha-Ann Alito, the nominee's wife, burst into tears and promptly exited the room, creating the most indelible memory of her husband's confirmation hearings.
The incendiary personal attacks employed by Democrats against Justice Alito were shameful, and they backfired by making Democrats look like bullies against an honorable man and well-qualified nominee. However, they also were an indication that Democrats, out of power and with little prospect of preventing Justice Alito's confirmation, were at least willing to put up a fight and scrutinize the nominee.
With news that President Obama has nominated U.S. 2nd Circuit Appeals Court Judge Sonia Sotomayor to replace retiring Supreme Court Justice David Souter, there already has been chatter about what sort of a justice Judge Sotomayor would be.

I live in NC and I truly feel sorry for those folks in SC who thought they were getting a solid conservative and a stand up guy. Graham has turned out to be neither.
It isn’t that long ago that a person with her radical views on the role of judges would never be nominated for a small claims court position. Now someone who proudly and openly admits to “making policy” and “making law” from the bench is celebrated and those who oppose her are predictibly labled racists, sexists, bigots and homophobes.
It should be easy to get 10 or 20 or her most outrageous statements, quote them absolutely accurately and then ask her to put them in context (so no one trots out that lame notion of “out of context”) and then ask her to explain how those statements are consistent with the law and the Constitution.
Republicans don’t have the courage to fight for anything.

I don’t expect the spineless GOP will do anything to stop this vicious racist. In fact I expect GOP bootlickers like McCain and Lindsay Graham to gush pukingly. When it comes to getting your hands dirty defending the Constitution, I don’t expect GOP country clubbers to volunteer. The Supreme Court is an illegitimate, un-Constitutional high priesthood of unaccountable mandarins.
The weak link, of course, will be Olympia Snowe of Maine. If she's the 61st vote for cloture, I predict that will tear the bloomers and you'll see her cross the aisle, and maybe Collins, too.
And quote her Learned Hand (in his eulogy of Benjamin Cardozo) and other uncontroversially solid Supreme Court justices of the past -- Holmes, Brandeis, and others -- about impartiality, and ask her how her comments square with them.

Already I’m hearing RINO’s telling the news media that this is not a fight to take on, that Sotomayor, appointed by Bush, is a fine legal mind and a good choice for SCOTUS. I just heard a ding-dong on Fox News tell Doucy that fighting this nomination would mean “clawing our way to the bottom”.
Bull Puckey! Sotomayor has a full body of work that bears close scrutiny. Her public statements are sufficient to keep her off the Federal Appeals bench, IMO, let alone SCOTUS. Her statement that the Appeals courts are where policy is made have been played over and over. Why are the Pubbies not listening?

I bitterly resent the msm commentary that both sides engage in typical drama when it comew to USSC nominations.
