Judge Sonia Sotomayor, President Obama's pick to become the newest Supreme Court justice, is on the record with some controversial remarks about 'diversity,' 'judicial activism' and female judges vs. male judges.
For example, the New York Times reported that in 2001, at the annual Judge Mario G. Olmos Law and Cultural Diversity Lecture, Sotomayor had this to say:
I would hope that a wise Latina woman with the richness of her experiences would more often than not reach a better conclusion than a white male who hasnt lived that life.
Whether born from experience or inherent physiological or cultural differences, she said later, regarding non-white, female judges, our gender and national origins may and will make a difference in our judging.
Also, there is a 2005 video of Sotomayor, speaking with potential law clerks, saying that a court of appeals is where policy is made. She added: And I know I know this is on tape, and I should never say that because we dont make law. I know. O.K. I know. Im not promoting it. Im not advocating it ...

Notice the subtle way her statement dehumanizes white men. She refers to her group as the wise Latin women but white men as mere white males.

I don’t think its out of fear. This is what they are taught is fair and proper in colleges and by the media. Of course the little guy should beat the big guy, the minority should beat the white guy, the poor should beat the rich, the perverted should beat the normal. These people didnt arise overnight. It took 40 years of breeding them in universities, MTV, and Hollywood. They are the mainstream, those with traditional American values are now the freaks.

I’ll be a contrarian and maintain that it is fear or at least apprehension of being perceived as retro or old fashioned.
Not to discount the reasons you cite, I agree with them, but that is the foundation for the opinion they cite.
Fear or intellectual sloth then makes them toe the Party line, kowtowing to the gods of conventional wisdom.
Either way, the result is the same!

Yes, reaching judicial decisions based on how feel, not on your interpretation of the Constitution. The perfect liberal candidate.
