WASHINGTON – President Barack Obama said Thursday some of the terror suspects held at Guantanamo would be brought to prisons in the United States despite fierce opposition in Congress. He promised to work with lawmakers to develop a system for imprisoning detainees who can't be tried and can't be turned loose.

"There are no neat or easy answers here," Obama said in a speech in which he pledged anew to "clean up the mess at Guantanamo" that he said the nation had inherited from the Bush administration.

...

Obama decried arguments used against his plans.

"We will be ill-served by the fear-mongering that emerges whenever we discuss this issue," he declared.

Speaking at the National Archives, Obama said he wouldn't do anything to endanger the American people.

He doesn’t understand that the ‘rule of law’ is intended for a country’s citizens to maintain order _within_ the country, not to conflate with or abridge wartime actions from foreign enemies.

Unfortunately it's the case that GWB did not set the entire 9/11 response on solid ground because he DID NOT demand a formal Declaration Of War from Congress from the very outset, and I have been baffled about that since Sept. 2001.

Had that been done we would NOT have these kinds of judicial and legal problems today.

And we would NOT have Zer0 taking advantage of the resulting ambiguity to return to the old Clinton program of "terrorism is a criminal act" and this new "preemptive incarceration", potentially of U.S. civilians.

The opportunity to conflate criminal law and military law has been - very unfortunately - provided by this very crucial decision at the outset, eight long years ago.

If it weren’t for Clown Pink and the ACLU etc, I would be all for dumping them into the general population of the roughest prison we have.

All of them would be exterminated within a month.

He has a declaration of war.

You guys keep bringing up this "formal declaration" yet nowhere in the Constitution is such a thing required.

"W" went out with a Congressional authoriation to do all the nastiness he needed to do.

Obama didn’t go into criminal law because he was afraid to visit his clients!

Obama initiated closing Gitmo.
So, naturally when the going gets tough-blame Bush.
It’s a perfect political issue for the Republicans and the bios and history of the terrorists will make for great political ads.
The Democrats knew Barry wanted to close Gitmo for over a year and they went along with it.
Now that they will be facing charges of coddling Willie bin Hortons at election time,
Congressional Dems are suddenly getting cold feet.

While I may agree that a formal Declaration of War would have been better, (although many wars have been fought without it), it is _delusional_ to think that the Democrats who have neither no interest in what the Constitution actually says nor worse, would not and have not uphold the principles embodied by it, would by the mere Declaration of War, change their approach to making Bush/Cheney responsible for every ill or perceived ill that exists today.

Obama’s speech can indeed be ripped apart, but why bother. It never hung together in the first place.

Obama seems to believe that he is above the law of contradiction. As Dick Cheney pointed out so clearly, there is a hard choice to be made. Either we treat terrorists as criminals or we treat them as enemies. It is logically impossible to compromise between these two contradictory approaches. Recent history clearly shows that the criminal approach doesn't work and the military one does.

Obama can't grasp this. He believes he can calibrate rhetoric and policy to walk a fine line between treating our enemies as criminal defendants and treating them as enemies who have placed themselves beyond the protection of all civilized rules. Obama comes to a fork in the road, and he takes it, repeatedly.

How many more deeply foolish speeches will this guy have to deliver before most people realize that he is deeply foolish. Here is a guy with, at best, average intelligence and the enemedia is still telling us that his IQ is “off the charts.”

How long can image and reality be so grossly at odds with one another?

that he said the nation had inherited from the Bush administration.

The lies are wearing thin. Oboma is a total screw up. Period. In fact, Bush is looking pretty good right now thanks to Oboma. He saved Bush's legacy without even trying.

I will note that President Bush never whined about the "terrorists he inherited from the Clinton Administration who flew jets into buildings in the US." President Bush simply dealt with them.

Obama didn't inherit the terrorists at Gitmo from President Bush, he inherited them from President Clinton.
