Boy, 7, Dies In Apparent Trespass Shooting

Gale and Sheila Muhs, seen here in booking photos, are accused of shooting two adults and two children they mistakenly believed were trespassing on their property.

HOUSTON - A 7-year-old boy who was allegedly shot in the head by a couple who thought he and three other people were trespassing on their property died Saturday, authorities said.

If I had been shot every time I trespassed as a youth, I’d have been killed hundreds of times. I’ve walked miles and miles in a straight line, crossing property borders a number of times on one walk. I’ve swam in other people’s ponds. I’ve used swimming holes. I’ve gone spelunking through caves. I’ve even hunted across other folks property as kids, with our 22s. There was no malice, and in the areas where we did this, the property owners couldn’t have cared less.

Curious, what made you think you had the right to trespass on other folks' property?

Perhaps you've forgotten what it's like to be 7?

Kids don't think about rights or trespassing, they think about where they want to go and how to get there.

Kids who haven't been taught better, or are too young to understand, shouldn't be treated like some undersized, evil adult.

Clyde Christ, a neighbor of the Muhs, was operating a tractor to grade the roads near the Muhs’ house, in 2004, when Gale Muhs took out his shotgun and shot at Christ. Mr. Christ says he filed a complaint with the Sheriff’s department, but nothing was done.

Inaction resulted when the process was followed. These two were trouble waiting to happen.
Prayers for the family, poor Don Jr....7 years old.

School - Read the F'n article/RTFA:
The victims stopped on a public access road and never even crossed over to the levee or trespassed on the Muhs’ property.

I re-read this one and noticed three things.

1. The author gets some unnecessary jabs on Texas gun laws towards the end.
2. These folks had prior history of violence, yet the authorities failed to protect the public. Exactly why we need 2nd ammendment + CHL + self-defense.
3. The pictures second ammendment flag and pistol have nothing to do with the story. Does the editor know a pistol t'ain't a shotgun?

I saw this on the Houston news the other night. They showed a SUV type truck with off road tires and caked with mud. I don't remember if they said the truck belonged to the Muhs or to the people who had been shot. Trespassers who come in and tear up your property are despicable, but SHOOTING them is NOT the way to handle it. You put up fences and call the Sheriff.

On Channel 2 news the other night they showed a truck with off road mud tires and caked with mud, not the one in the picture. Did that belong to the Muhs or the family who was shot?

.............................You are wrong. Yes, in Texas, you can use lethal force to protect property under certain situations, one of them being after dark, another is when there is no possible safe way to stop someone from stealing your property.

That may be so...but you can still be tried in federal court. US Supreme Court decsion in the 80’s I think. If state law allows this then you are subjected to a criminal court on the Federal level. Much worse prospect I think. Federal courts don’t screw around.

Bottom line in that opinion is that you can never ever use lethal force to protect property only life.

Shooting a human being is not a federal jurisdiction in itself.And if you can’t use lethal force to protect property,why do banks use armed gaurds?

According to the above article the women were in a SUV with two children in the back [Destiny was hit in the SUV]. The men and the boy that died were in the jeep and had stopped for a bathroom break. I don’t know if the SUV on the tv was the one they were in but my guess would be it was. In any case it appears that they were on public property and not on the Muhs property when the shooting occurred. My guess is the levee that the Muhs woman was telling the 911 operator about is also public property.

Question off topic to this thread. I saw you mention on another thread you raise bucking bulls. Do you provide stock to the rodeos or are you just breeding/raising them and then selling to the stock contractors?
