The officer felt "threatened" Undoubtedly the victim made "threatening gestures" too. I'm guessing the officer in this picture undoubtedly felt threatened too

Off-duty police who insist on confronting ‘suspicious’ people are a menace.
I’d have assumed this out-of-uniform officer was a mugger or a mafiosi, and acted accordingly. Any one of us would.

Since he is a police officer he only has to say that he was afraid and everything is ok. If it was a normal person he would be charged with murder.
