Henry vetoes legislative resolution (10th amendment)
Tulsa World ^ | 04/24/2009 | Barbara Hoberock

Gov. Brad Henry on Friday vetoed a measure that he said suggested that Oklahoma should return federal tax dollars and that federal officials had violated the U.S. Constitution and committed crimes against the states.

Billed as an expression of support for the 10th Amendment, House Joint Resolution 1003 made a number of allegations without explanation or evidence, the Governor’s Office said.

The 10th Amendment states that powers not granted to the national government or prohibited to the states are reserved for the states or the people.

Sen. Randy Brogdon, R-Owasso, is the Senate sponsor of House Joint Resolution 1003 and has announced that he is running for governor.

Brogdon disagreed with Henry’s interpretation of his resolution, saying it did not suggest turning down federal funding.

He said it is unfortunate that a resolution endorsing the 10th Amendment is needed but that Washington, D.C., is over-reaching and using powers outside those listed in the Constitution.

Henry said in his veto message: “Without question the state of Oklahoma and its leaders support the U.S. Constitution and the rights it guarantees the states and their citizens, and there is no need to spend valuable legislative time on a resolution expressing support for any particular amendment or constitutional right.”

...and there is no need to spend valuable legislative time on a resolution expressing support for any particular amendment or constitutional right.”

The funny thing is that now MORE "valuable legislative time" will be used on this bill in an attempt to override his veto. Supposedly there is enough support for an override in the Oklahoma state House, but the state Senate is iffy.

The same Henry who blew off another act of the legislature and picked a new “state song” that had no reference to Oklahoma at all.

Was this Bill similar to the Bills passing in other states that are flexing their 10th amendment right?

We cannot count on our elected FEDERAL officials to uphold the Constitution.

Now, we can no longer entrust our elected STATE officials to protect our rights.

We have tried the soap box, to no avail.
We have tried the ballot box, to even worse results.
That leaves us with no alternative, save subservience, but the only box remaining.

NH state motto was once “Live free, or die.” They abandoned that for expediency and to “get along”. Is Eric Holder correct when he calls America “a nation of cowards”?

Let’s just breathe deeply for a moment... My floks always suggested to count to 10 before doing something really stupid...

I don’t think we’ve got only one box left — YET. I assume you refer to the Ammo Box. This crisis isn’t fully upon us yet. Many people are still “just waking up.” We have a year-and-a-half until the next election. We have THAT much time, barring a national emergency (terrorist attack, total economic collapse, pandemic). If none of these events occur — which would INVITE the Liberofascists to suspend the Constitution (formally), then we have about 18 months to win AT the ballot box. And we CAN — if we keep up the Tea Party push backs.

Admittedly, if the Census and the Courts can fix it so that we CAN’T win, then the next election may be a forgone conclusion — and our options MAY be reduced — to one. But we’re not there YET. I’m praying we don’t get there, working to keep us from there, but preparing in the event that we DO get there. I encourage ALL Freepers to do the same.

Keep your powder dry — and in the horn — for now, Ladies and Gentlemen.

Thanks JSDude1! This one's a shocker to me even though relatives in OK that all but assured me their Dim governator would most likely not sign this resolution. Still in all, OK is a VERY conservative State so it's entirely possible he may be serving his last term as governator. Folks in the Sooner State, make it so...

I've really been studying the right of secession lately..

If the people make the States and the States make the Federal Government couldn't the First secede? The Attorneys surrounding George Washington definitely felt the State had the Right

Personally.. I think every Tax payer should secede and starve them out!

Since when could a Governor veto a legislative resolution? I thought a resolution was just the sense of the legislature, not needing a Governor's approval.

Better, I think, that legislatures do this sort of thing than passing a bunch of needless laws just to have something to do. Remember, the states' power over the federal government has been all but nullified since direct election of Senators came to pass.

"A republic," he said, "if you can keep it."

The States did not create the federal government. Special representative conventions outside of the normal State legislature were called. The conventions were held by State, but they were not “State government.” The People created the federal and the State constitutions which delegated power and authority to both governments. The People are sovereign.

Governor Sleeps A Lot, Lazy, ZERO kneepadder is on his last term. Before 2006, he would not have vetoed this, but ever since ZERO was elected he has been flexing his muscle. He was too chicken before because he never should have been Governor.

The OK GOP candidates for statewide office are going to be reminding voters of this Conservative state that Governor Doofus represents the Democrats and tie all of them to him and ZERO. Most of the Dems statewide supported ZERO even though the Dems in the State went for Hillary.

Time to throw out the statewide Dems and return Common Sense to Oklahoma.

Gov. Henry can’t be voted out of office. He’s in his second term, and he can’t run again, because of term limits. He says that he might run for the U.S. Senate, in 2010.

"Still in all, OK is a VERY conservative State "

Won't be for long. ACORN is coming to conduct a "scientific" census very soon.

Plus, much of that $4.5 billion is to be used to relocate a few-hundred-thousand eastern-city folk to recalcitrant states like yours.....{:-)
