Hey, rework the headline! There ain’t no such thing as an “Ex Marine” (even if that is what the article headline says)!
Well, murtha is an ex-Marine, but he is the only one I know of.
Balls of Steel takes on a Piece of Shit
and BOS ain’t no “Ex-Marine”
The Appeals Court ruling that Murtha was immune from a lawsuit because the remarks were made as part of his official duties is bullsh*t as well.
First of all, Murtha was making gratitous unfounded accusations apart from his duties as a congress critter, just as the new defamation suit claims.
Second of all, even if they were made as a part of his genuine duties, the accusations were so reckless and over the top, this defense would not stand. Recall exactly the same defense being made in the Nuremberg Trials and said defense being dismissed because the actions of the accused were so far beyond the standards of normal, civilized behavior that the worst of the lot were hanged anyway.
Under the appeals court standard, the only one who would have been hanged was Julius Streicher, because he was the only one of the defendants acting outside official nazi government capacity.
Justin is a retired Marine, murtha is an ex-Marine.
I hope that this FORMER MARINE wins his case.
BTW! There is NO such thing as an ex-MARINE, just those who are no longer on duty.
I wish someone would inform the AP & the rest of the media that an âex-Marineâ is a Marine who has received a Dishonorable Discharge. All other Marines who are no longer âactiveâ are referred to as as “former” Marines or as Marines; just as active Marines are referred. PERIOD!
There are damned few “Ex-Marines”. Murtha is one in my opinion.
It is my good fortune to know many Marines, Marine Veterans and Retired Marines.
I used to work with Justin’s mother and met the whole family many times while working there. They are some of the most decent people you’d ever meet. Murtha is truly evil.

It is legal, because it is constitutional. Yet, there are limitations.
They shall in all Cases, except Treason, Felony and Breach of the Peace, be privileged from Arrest during their Attendance at the Session of their respective Houses, and in going to and returning from the same; and for any Speech or Debate in either House, they shall not be questioned in any other Place.
It appears to me in reading the above, that they are not immune if they have committed treason, felony, or breach of the peace.
Next,it appears that for speech or debate IN EITHER HOUSE, they are immune from questioning.
They can't commit crimes and speech that deals with their duties is immune.
To me, the conclusion is inescapable. If Murtha is immune for his pre-trial conviction of the Haditha Marines as murderers, then his duties include the trials of US service members. If that is so, if these trials are his duty, then he MUST BE a source from which Unlawful Command Influence can flow.
If the trials of service members are NOT his duty, then he should be prosecutable for maligning these Vets.
They can't have it both ways. Murtha's comments are either illegal or they constitute meddling in the trials, unlawful command influence.
