Over five months after the election, a three-judge panel has declared Democrat Al Franken the winner of the Minnesota U.S. Senate race.
The judges issued their final ruling late Monday, stating "Franken received the highest number of lawfully cast ballots in the Nov. 4, 2008 general election."
They also have determined that Franken is entitled to receive the certificate of election.
Last week, Republican Norm Coleman suffered a blow after a few hundred previously rejected absentee ballots were opened and counted at the tail end of Coleman's lawsuit contesting his loss in a statewide recount. They broke almost 2-to-1 for Franken to pad his lead to 312.
Outside the courtroom, Coleman attorney Ben Ginsberg minimized the new margin because his side was certain to appeal to the Minnesota Supreme Court.
"What happened today in the sphere of this election is really inconsequential," he said. "There's a much larger universe of ballots that should be opened."
Ginsberg said he hopes the high court would reinstate as many as 4,800 absentee ballots rejected by local officials.
Top Franken attorney Marc Elias said he doubted an appeal would change things.
"The problem that former Senator Coleman has is he lost fair and square," Elias said. "He lost because more people voted for Al Franken than voted for Norm Coleman. No amount of lawyering or sophisticated legal arguments is going to change that."
Secretary of State Mark Ritchie, a Democrat, said he would welcome an appeal, saying he thinks the state's highest court could provide closure.
The appeal must come within 10 days after the final order from the three-judge panel that presided over the seven-week trial.
You are correct and the dems will continue to cheat with the help of Soros and ACORN and until some conservatives figure that out we will continue to lose. That is why I disagree with calmly trying to work on a local level to get conservatives elected as a way of getting back our country. I don’t think it will work until we eliminate voter fraud. We are going to have to hit the streets and fight this, not by the ballot box!/rant
IMHO, that is why we are in the position we are in. Franken is a great example.
“Thank all of the bloody ScandiLutherans...”
Mom’s parents were straight from Sweden and she has never voted for a Dem.
She’ll be 92 in November....
“Minnesota...you suck. And soon youll know just how much.”
Minnesota has sucked for a hell of a long time. It is completely enamored with socialism. I’ve handled several cases there, and believe me, Minnesota courts are EXTREMELY liberal.
This is PRECISELY what is terribly wrong with our country these days. The Senate was intended, by The Founders, to be the moderate voice of Statesmen, who were meant to protect our Constitutional rights from being trampled by the passions of the moment among the Representatives, stoked by the Executive, and misguided by the Judiciary. Our great vulnerability these days arises from the fact that our Constitution didn't anticipate a corrupted Senate, staffed by miscreants like Franken, Boxer, Obama, Biden, etc., etc..
Al Franken fits in with the senate perfectly. You won’t find a bigger bunch of fools and failures in the entire US of A.
Garrison Keillor effect...
I am Soooo surprised! /NOT!
A Poser in the White House,
a Pedophile in Congress, and
a Pervert in the Senate.
Aren’t we just the lucky bunch?
Are you happy, now, RINOS???
I call BS. But then, a socialist won so the "rest" hardly matters.
Now, more than ever....
EVERYBODY.....
Get thee over to the FREEPATHON and give whatever you can to help keep the lights on here...
OK....I’m beggin’ ya......
“...your team is down by three, and you’re giving up?”
Down by three? I wish.
“I dont think it will work until we eliminate voter fraud.”
At the very least ACORN has to be dismantled and destroyed.
If I ventured a guess, I'd say its a lock for Coleman. Elections should not be determined in the courts, which is what Richard Nixon knew in 1960 when he declined to tear the country apart to challenge Kennedy. Gore chose otherwise, so here we go...
Given the POS that are Dems, I say sue the bastards..never give in.
The truth here is that Minnesota now has only one senator. With Franken in he will represent Hollywood, not Minnesota. Now California has 3 senators.

“How about we just trade Mpls./St. Paul and Duluth.”
Throw in Rochester for good measure.
“The rest of us love America and didn’t vote for the putz Franken.”
I am sure that’s true!
My husband is a native Texan, if you guys leave the republic (Please oh PLEASE) does that mean as his wife I get to immigrate as well?????
The Senate now has everything but a good set of clown suits.
The entirety of the U.S. Senate gets to live with this photo, if I have any say about it. They're almost all as low or lower.
IMHO
And for all of the Ben Stein fans.....
He backed Franken and gave him money.
