School superintendent June Atkinson plans to sue the state so she can run the state Department of Public Instruction. The suit will be announced at a news conference tomorrow.
She will be represented by former Supreme Court Justice Robert Orr, who runs the N.C. Institute for Constitutional Law. Gov. Beverly Perdue, the State Board of Education, and William Harrison, whom Perdue appointed to run the education agency, will be defendants, Orr said.
Atkinson, who was elected to a second term in November, has never run the state education agency. The state constitution and state law have made muddled mess of the question of who is supposed to run the education department. Though some elected superintendents have been in charge, Atkinson, who was elected to a second term in November, has never run DPI.
Atkinson said the state constitution gives her the responsibility, and said it's time for the courts to settle the question. "People vote thinking they're electing someone to administer and manage public education," she said. "I believe that it's time that we have some clarity."
Educrats consider their jobs and careers to be entitlements and the Democrat establishment wouldn’t have it any other way.
To clear something up for those not playing along at home, this is Democrat-on-Democrat violence. Atkinson is a Democrat, was elected to her position, and by all appearances should be in charge of the Department of Public Instruction.
Gov. Perdue is also a Democrat. What her motivation is for this blatantly unconstitutional move, I have no idea.
Bob Orr is a Republican, former state Supreme Court judge and candidate in the GOP primary for governor last year.
I was sorry to see him decide to not run to keep his seat on NC’s highest Court but understand fully why he didn't.
That being said,,,nothing beats D on D violence!
It would be great if he could run for Senate 47 against Joe Queen.
It seems like this would be good thing to clear up.
Personally, I don’t think it should be an elected position anyway. Some year, a Republican may be governor and an idiot could be elected to this position.
