Has the federal government exceeded, or is it on the verge of exceeding its constitutional authority with the recent series of events connected to rescuing an ailing banking system?
Although Rep. Michele Bachmann, R-Minn., was ridiculed for raising that question in a congressional hearing on March 24, conservative talk show host, constitutional lawyer and legal commentator Mark Levin, told Fox News Channels Your World with Neil Cavuto on March 24 that government was indeed exceeding the constitution. According to Levin, there is nothing in the Constitution that would allow the Obama administration to expand the governments ability to seize non-banking financial institutions as Treasury Secretary Timothy Geithner has proposed.
Its unbelievable, Levin said. There is no constitutional authority for this. I thought the American people like capitalism. I mean look, we luxuriated in this society as a result of the market system.

Preach it, Mark!
They are overthorwing the US Constitution!
When will we say enough is enough?
Constitution??
You mean that OLD thing?
Too many democrats no longer care about the Constitution, and the socialist thug in the White House is so far beyond the Constitution that he probably thinks trampling on the Constitution one more time as casually as his terrorist buddy (Ayers) tramples on the flag is no big deal.
BTW, anyone looking for Levin’s new book, try Target if your local booksellers are all out. I got a copy there this afternoon.
Well, as a starting point, somebody has to go to court on these issues.
Realistically, the administration and congressional Democrats will do what they want, unless restrained somehow. Lawsuits will have to be filed to rein Obama in. Unless stopped by Congress or the courts, a president will do what he wants and dare anybody to stop him. He will assume he has authority to do anything, unless someone or something restrains him.
With all due respect what good will going to the courts do????? Any case will just be dismissed as lack of standing.
Leftists think that way -
one person, able to articulate a “better” plan
is superior to any contract written in the past.
I ordered two copies from Amazon yesterday and they were still available.
5 boxes of liberty, and they’ve made most of them moot.
soap box - Fairness Doctrine
ballot box - ACORN has destroyed it
moving box - All laws are federal/inescapable
jury box - federal courts infested with leftwing activists
cartridge box - wow... any wonder why you can’t find ammo? It’s all that’s left.
I called B&N before I tried Target. Got a snarky clerk who told me they were all out before I’d finished getting the title outta my mouth. The clerk had no idea when more were coming and didn’t sound terribly sad about it, either. Target’s actually got a pretty decent selection of bestsellers, and at 30% off, too.
Didn’t the courts declare some of Roosevelt’s new deal programs unconstitutional? I thought that within our system, only courts can declare some law or some action unconstitutional. If courts will say someone lacks standing to bring the lawsuit, then our goose is cooked.
By my count the retroactive, punitive taxation of SIG/bail-out bonuses is contra-constitutional on EIGHT counts!
Right after Rush recommended the book, I down loaded a copy to my Kindle for $9.95. Now all I have to do is keep my younger dog (half Black Lab, half Pit and 83.5 lb.) from eating my second Kindle the way he ate my first.
Soros / Obama wants the hedge funds next and probably some private insurance funds like New Hampshire is confiscating. I would hope they have lawyers and would certainly have standing.
