Judge Threatens Calif. Officials With Contempt

SACRAMENTO (AP) ―

A federal judge is threatening to hold Gov. Arnold Schwarzenegger's administration in contempt if they don't quickly come up with a plan to take care of thousands of mentally ill inmates.

U.S. District Judge Lawrence Karlton in Sacramento says he is appalled by evidence the state is not capable of doing its duty.

He called it "mind-boggling" that the state still doesn't have a mental health treatment plan 14 years after a class-action lawsuit was first filed on behalf of inmates.

On Tuesday he ordered the state to consider moving hundreds of inmates to vacant beds at state-run psychiatric hospitals. He gave officials 60 days to come up with a plan.

I may be going out on a limb here, but I do believe this judge has overreached his authority.

As a US citizen you have the Constitutional right to not be subjected to "cruel and unusual punishment."

Prisoners who are mentally ill and not cared for properly (or at least adequately) are an inordinate danger to themselves and other inmates.

I believe the judge has a right to rule here.

We can all say what a good thing it is that all criminals no matter how minor the offense are daily subjected to criminal rape and improper medical care (Whoo-whee ... the creeps are getting what they deserved yessirree Bob!)

But when Obama starts putting away folks for defending their 1st and 2nd amendment rights, will we want all those folks subjected to the same foul treatment?

Especially if those folks are us?

Admittedly, I don’t know much about this case, but I find myself frequently disagreeing with what many consider ‘cruel and unusual punishment’. Much the same as ‘separation of church & state’, its a term frequently abused by leftist judges for their own social agenda.

I know that an increasing percentage of our County budget is going to mental health treatment of jail inmates. Criminal behavior is antisocial and that appears to be a diagnosis. Also about 75% of inmates are substance abusers -with a high number of meth addicts. That all has to be treated at the taxpayer’s expense.

Better that, they are not worth billions of dollars - they are scum.

We had a federal judge run the prisons in Texas for about 30 years. For "overcrowding". If there were too many prisoners in the State prisons - in his opinion - the State had to furlough or early release prisoners until he deemed the prisons "no longer crowded". It was a revolving door, as new prisoners were always on the way back into the prisons.

Federal judge William Wayne Justice (spit) if memory serves.

Then the good folks of Texas should have spent enough money to build enough prisons to keep the prisoners off the streets.

At least in Texas with a strong Republican contingent and a lot of Blue Dog Democrats you have a good chance that tax dollars will not be completely wasted like they are here in the land of fruits, nuts, and flakes.

Why not spend enough on jails?

Why not spend enough to keep roads in good order and levees from collapsing?

It is not a conservative idea to starve government to the point that it can't provide what little service it is supposed to supply.

And if the scumbags in Austin are frittering money away on useless things then you need to have a monster truck rally down there and crash the pork party.
