IS SPITZER MADOFF UNDRESSED? Federal investigators are reportedly examining “structuring” in connection with the Spitzer's prostitution activities. If Spitzer "structured" cash transactions to evade reporting requirements, he may be guilty of a felony.

31 U.S.C. 5324 prohibits certain actions by any person who acts with the purpose of evading the reporting requirements of Section 5313 (Currency Transaction Reports).

The elements of the structuring regulations are: A person acting alone, in conjunction with others, or on behalf of others, Conducts or attempts to conduct, One or more transactions in currency, In any amount, At one or more financial institutions, On one or more days, For the purpose of evading the reporting requirements of 31 C.F.R. 103.22 (requiring CTRs).

The definition is specifically written to include those transactions which occur beyond a single business day and transactions which are conducted through more than one financial institution. (The definition of "structuring" for purposes of currency transaction reporting is found at 31 C.F.R. 103.11(gg).)

L/E needs to investigate the financial activities of Spizzer's alleged pimp, Mark Brener, Cliffside Park, New Jersey--------the 62-year-old mastermind of the Emperors Club VIP brothel supplied prostitutes to a worldwide clientele.

News reports said Brener was apparently certified by the IRS to represent taxpayers in disputes. It was also reported Brener worked for the Israeli national tax collection agency. Israel was named as one of the world's top money-laundeirng havens. The Knesset tried to change the law---but Orthodox political parties balked.

An Israeli passport and $600,000 in cash were found in Brener's New Jersey apartment. This is significant since Israel is the only country in the world where an individual can alight from a plane, go to a bank with a suitcase full of cash and no one ask where it comes from. US autorities say most of the suitcase money going into Israeli banks emanates from the US as a result of criminality.

The Emperor’s Club is/was an international operation and may have been run as an “escort service” as a front to launder embezzled money and the poceeds of government fraud in order to evade US banking laws, the FEC, the IRS and the SEC.

Mark Brener was well-traveled. He lived in New Jersey, and had 50 prostitutes available in New York, Washington, Miami, London and Paris, according to a complaint unsealed on Thursday in Federal District Court in Manhattan.

The hooker appointments, made by telephone or through an online booking service, cost $1,000 to $5,500 an hour and could be paid for with cash, credit card, wire transfers or money orders, the complaint said.

Wire transfers would facilitate embezzling, offshore money laundering, IRS fraud and evasion of US banking laws---and the facilitation embezzling for johns via high-priced trysts with prostitutes.
