Dear Pro-Life Friends:
Operative excerpts of the regulation state,
"The Department is proposing to rescind in its entirety the final rule entitled "Ensuring That Department of Health and Human Services Funds Do Not Support Coercive or Discriminatory Policies or Practices in Violation of Federal Law," published in the Federal Register on December 19, 2008 (73 FR 78072, 45 CFR Part 88). Commenters asserted that the rule would limit access to patient care and raised concerns that individuals could be denied access to services, with effects felt disproportionately by those in rural areas or otherwise underserved. The Department believes that the comments on the August 2008 proposed rule raised a number of questions that warrant further careful consideration. It is important that the Department have the opportunity to review this regulation to ensure its consistency with current Administration policy. Accordingly, we believe it would benefit the Department to review this rule, accept further comments, and reevaluate the necessity for regulations implementing the statutory requirements. Thus, the Department is proposing to rescind the December 19, 2008 final rule, and we are soliciting public comment to aid our consideration of the many complex questions surrounding the issue and the need for regulation in this area."

1. Information, including specific examples where feasible, addressing the scope and nature of the problems giving rise to the need for federal rulemaking and how the current rule would resolve those problems;
2. Information, including specific examples where feasible, supporting or refuting allegations that the December 19, 2008 final rule reduces access to information and health care services, particularly by low-income women;
3. Comment on whether the December 19, 2008 final rule provides sufficient clarity to minimize the potential for harm resulting from any ambiguity and confusion that may exist because of the rule; and
4. Comment on whether the objectives of the December 19, 2008 final rule might also be accomplished through non-regulatory means, such as outreach and education

Background: In August, 2008 the Department of Health and Human Services proposed regulations to implement a series of federal laws protecting medical personnel who refuse to participate in abortion-related activities from discrimination. Federal laws include the 1973 "Church Amendments", the 1996 Public Health Service Act amendment, and the 2004 "Hyde-Weldon amendment". The regulations were finalized on December 18, 2008 and went into effect January 20, 2009. The regulations are intended to educate those in the medical field as well as the general public about the rights of medical personnel to treat their patients in accordance with their conscience free from discrimination or intimidation. They also give health care professionals recourse to the HHS Office of Civil Rights and a way to press charges in the event they experience discrimination. In addition, the regulations are limited in scope to the federal laws and while protecting applicable individuals and health care entities from discrimination, they do not limit or restrict any legal practice or product.
Legal and Legislative Challenges to the Regulation: On January 15, 2009 Planned Parenthood, the National Family Planning & Reproductive Health Association (NFPRHA) represented by the American Civil Liberties Union (ACLU), and the attorneys general of Connecticut, California, Illinois, Massachusetts, New Jersey, Oregon and Rhode Island filed three separate lawsuits in federal district court in the District of Connecticut seeking to invalidate the HHS conscience-protecting regulations. In response, the Catholic Medical Association, the Christian Medical Association, and the American Association of Pro-Life Obstetricians and Gynecologists (AAPLOG) represented by the Christian Legal Society and the Alliance Defense Fund, as well as Concerned Women of America (CWA), Christian Pharmacists Fellowship International, Care Net, Heartbeat International, and the New Jersey Physicians Resource Council represented by Advocates International filed motions to intervene as defendants on January 22 and February 3, 2009 respectively. Also, Senators Hillary Clinton (D-NY) and Patty Murray (D-WA) introduced S. 20 in the 110th Congress and Rep. Diana DeGette (D-CO) introduced the Protecting Patients and Health Care Act of 2009, HR. 570, in both the 110th and the 111th Congresses, which would nullify the regulations.
Breaking News: The
Washington Post and
ABC are reporting that President Obama plans to rescind the Bush policy limiting federal funding for embryo destructive research on Monday. According to news reports, a signing ceremony will take place on Monday at 11 am. Details about the Executive Order are not available, but according to the Washington Post, "proponents expect Obama will simply lift the restriction without caveats and let the NIH work out the details." Just this week ten pro-life Members of Congress spoke on stem cell research during a Special Order organized by Rep. Chris Smith (R-NJ).

There are no words to describe the culture of death in this this administration.Absolutely true. Words are insufficient conveyors of what I think about B.O.'s treatment of the unborn. All I have are completely sickening feelings in my gut---a revulsion of mammoth proportions for what this administration is doing. May God have mercy upon us.

Once Speaker Pelosi uses her position as “Speaker of the House” to pressure or intimidate other elected Catholics into supporting this, she should face Excommunication. The standard “I’m just reflecting the views of my District” defense won’t hold holy water; when SHE goes on Offense, as Speaker {rather than just Voting “the will of her District”}.
Her “MY way, or No way” methods are not justified as part of her {professed} Catholicism.
IF she gets excommunicated before her 2010 run for re-election, We’ll have race to watch!

Interesting you ask that, I read an article this morning (sorry, can’t find it now, I’ll keep looking) asking just this: “WHY is there NOT more opposition to Sibelius?”
Her own Archbishop has come out emphatically against her appointment, given press interviews, and also told her she is not in a state of grace and must not present herself for Communion. (Naumann, one of those weird bishops who actually upholds Catholic teaching.)
So given that outspoken archbishop in Kansas City, I would think pro-lifers would be rallying. However, we have to admit that right now all the life groups, Catholics and Protestant, have their hands full, and are probably in a quandary of which Obama death proposal they should fight next, as they are flying out of the White House and U.N. in all directions at a stunning pace.
