ORDER For the reasons set forth in an accompanying memorandum, the defendants' motion to dismiss [#9] is granted, and John D. Hemenway is ordered to show cause within eleven days of the date of this order why he should not be sanctioned under Rule 11(b) of the Federal Rules of Civil Procedure.

I can only wish that this will encourage people to drop these fruitless lawsuits and focus on something productive.
Like maybe an initiative to pass laws at the federal or state (or both) levels requiring a candidate’s BC before he/she is able to run.
That would be getting something done. All these lawsuits do is make legitimate conservatives look stupid. We should be above the dumbassery of conspiracy theories that will never amount to anything. That’s for liberals. (anyone talked to a “9/11-truther” lately? They’re still as nuts as they were when they first came up with their paranoid fantasy)
Do you think the Framers would have considered the son of a British subject a natural born citizen?
My bad, to a well-seasoned Freeper from WAY back. :-)
“For a duck may be SOMEBODY’S mama...”
Please define YOU. What I want to know is WHO.
The COLB is a real document in which the State of Hawaii certifies the facts of his birth, including location.
That is all that is necessary to establish his eligibility.
The rest of the information on the original form is not relevant.
You have had it pointed out to you before that a Certificate of Live Birth is not that same as a Birth Certificate. You also had links posted to you that showed that Hawaii does not accept a COLB as valid proof of birth. There were also links posted to you that showed that a person can have a COLB amended. You tried using Fact Check as a source.
No, it is a certified copy of information that is on the birth certificate. Are you seriously suggesting the state of Hawaii lies on its officially certified documents?
You also had links posted to you that showed that Hawaii does not accept a COLB as valid proof of birth.
Not a single one of the links you posted showed that.
There were also links posted to you that showed that a person can have a COLB amended.
So?
You tried using Fact Check as a source.
So?
Example: for years, rumors about Napolean's death were rampant, but those in power argued that he died a natural death. More than a century later forensic analysis determined that he was in fact poisoned.
You have had all of this posted to you before and you fled the thread.
I Beg to differ. Show me where on the COLB it identifies the location. All the Certificate says is that a birth has been recorded. Do some research, and you’ll find that even Hawaii does not use its own COLB as proof of birth in Hawaii, but requires a birth certificate in many instances.
Obama’s sister — who by her own admission was born in Indonesia, has a Hawaii COLB. Just like her brother.
It's right there, under the heading "city, town, or location of birth."
You can find closeup photographs here:

That's just not true.
Obamas sister who by her own admission was born in Indonesia, has a Hawaii COLB. Just like her brother
Another unsubstantiated internet rumor.
You file a frivolous lawsuit and you run the risk of sanctions. This issue is a constant and consistent loser no matter what court its been in or who the judge(s) are/were and even the branch of government. Anyone that continues to pursue this in court needs to be sanctioned now for wasting taxpayer money. It's a waste time and money.
I wholeheartedly disagree.
I don’t think the Founders would have added the clause “or a Citizen of the United States, at the time of the Adoption of this Constitution” That clause grandfathered in those who were not born in the Colonies. The Founders were clear regarding subject to the jurisdiction thereof.
They didn’t say subject to British, Kenyan, French jurisdiction - ie to be inclusive. They were clearly being exclusive of other foreign jurisdictions.
Do you even know what "Native Hawaiian" means in Hawaii?
It means you have to have Hawaiian ancestry. The only reason the Department of Home Lands doesn't accept a COLB is because it is not sufficient to prove ancestry, which, last time I checked, is not a requirement for the presidency.
