MARINE VETERAN KICKED OUT OF SCHOOL FOR POSSESSING FIREARMS
WOU STUDENT TRIED, CONVICTED AND SENTENCED.The WOU student who was falsely arrested and charged with possession of a firearm in a public building, had all his criminal charges dropped by the Polk County DA tonight.The DA admitted no wrongdoing on his part, or on the part of the police who arrested Jeff Maxwell for a "crime" that does not exist.In a statement released to OFF's attorney, the DA said "I believe the Monmouth Police Department issued the citation in good faith and that there was an arguable violation. However, a careful reading of the statute and the facts led me to conclude the charge was not in the best interest of justice."
"Not in the best interest of justice."
There was NO CRIME. But it gets worse. Much worse. The college still got to "try" Jeff Maxwell. And they did tonight. The tribunal that tried Marine veteran Jeffery Maxwell laughed after suspending him from Western Oregon University and sentencing him to:a "psychological evaluation stating he is not a threat to himself of others" and a mandatory "ten page paper" " with references, "citing, but not limited to: 1) the importance of following the law,even through civil disobedience. 2) the importance of accepting responsibility for one's actions 3) and recognizing the impact possession of weapons on college campuses has on others." So, Maxwell has been told his lawful possession of a firearm on campus is evidence of mental illness and he must "confess his sins."
Welcome to the new Politburo. Maxwell may as well been judged by the Hitler youth for his "thought crimes." Jeffery Maxwell's "jury" were four unnamed students and one staff member of WOU.
The "prosecutor" was Patrick Moser moserp@wou.edu "Acting Coordinator of Campus Judicial Affairs" Maxwell asked to have his "trial" open to the public, which is his right, but was denied.The tribunal was told repeatedly that they lacked the authority to impose a rule dealing with firearms. But the children who sat in judgment of the veteran were not interested in the law or the facts. They were only interested in attacking and embarrassing a man who had committed no crime but had chosen to exercise his right to protect himself and others.The "trial" was a sham. No one present even seemed to know what the "charge" was. When confronted by the fact that the school has no authority to make rules about firearms, they said that was "not relevant." Then they said they were not charging Maxwell with having a firearm. When asked what they WERE charging him with, they seemed to not know. They then said they were charging him with having a "knife and a rifle in his car." When told they had no authority to make rules about guns in his car, they said THAT was not "relevant."The children who sat on Maxwell's "jury" and their staff advisors seemed to have no idea what they were actually charging Maxwell with. But they had no problem sentencing him. Gun owners, and all Americans should be outraged.OFF is committed to continuing Maxwell's defense.
We are shocked and disgusted by the treatment he received by the staff and the students of WOU,We ask your continued support of our legal battle for Jeff Maxwell. We promised Jeff what he promised the men he served with. We will not leave him behind.

Where is the NRA? This is the sort of thing that ought to be litigated with their help.

No, he only had to do those things if he wanted to stay in school. The whole thing is just BS and I would sue their collective asses off if I was this guy. Apparently that is what he is doing.
It is legal in Oregon for those with concealed weapon permits to carry a weapon on any public property (including public schools) except courthouses.
If it was a private business, they are well within their rights of saying no weapons allowed.

This very much depends on their local laws, and it is clear that there are at least some state legislators there who do not see it your way. Pronouncements of a university president are not law, no matter how much they may think so. I hope this particular university president gets an expensive lesson in this fact.

Doesn't this "university" realize that Mr. Maxwell is a paying student (i.e. a customer)? If it were me, I'd tell them where they can shove their 10 page paper. There are many other university's to go to.

Hello, I am Patrick Moser. I am a part time student of the CSSA program and work full time at Western Oregon University as the Assistant Director, Facilities and Operations in the department of University Residences.
I grew up in Gresham, Oregon and after I graduated from high school I moved to Monmouth to get my teaching degree. In college, my plans changed when I discovered the field of Student Affairs. I was lucky enough to serve as a Resident Assistant, a Hall Director and get involved in student government as an undergraduate. I graduated with a degree in Speech Communication and was ready to work in residence life.
My career started at WOU in 1996 when I was hired as an Area Coordinator, a position I held for three years. I started a masters degree program at Portland State University while working full time. The commute to Portland and the masters program was not all that I was hoping it to be, so I decided to take a new direction and that has led me to Oregon State University and the CSSA program.
During my ten years in University Residences at WOU, I have had the pleasure of advising and instructing students. This truly is my passion! I had the opportunity to advise the Residence Hall Association at WOU for six years and it is probably one of the most rewarding times in my career to this point. Working with students in leadership positions and helping facilitate their growth through their leadership experiences is at the heart of the Student Affairs profession.
Outside of my work, I am deeply involved in the community of Monmouth. I was on the Monmouth City Council for five and half years. I believe civic service and giving back to the community is a vital part of being a member of a community and I try role model that value to the students I work with on campus.
I enjoy spending time with friends, traveling, watching and participating in sports, golf, tennis and fishing.
I look forward to the challenges of being a half time student and look forward to working with and learning from as many colleagues in the CSSA program as possible.

On further review of the afore post and links thereof, I believe this fellow has an excellent chance to sue the pants, shirts socks etc. off the administration, student board, evertvyone(including the police)
Since when does “policy” of any college supercede state law and Constituation?
Would a “policy” of “no negroes” supercede the civil rights of Blacks/?

I too sent a note to Mosrep or whatever the guy’s name is.
If Maxwell violated a clearly stated university policy (i.e. no weapons on campus) and they want to suspend him, fine. But dispense with the paper and psych eval nonsense. That’s just evil vindictiveness in my book.
Maxwell should write a paper that says “Suck my @ss you commie bastards” on ten pages.
I see a lawsuit the will cost the state a few hundred thousand dollars.
Schools are PUBLIC property owned by the state. Apparently the law prohibits public universities from infringing on a person's 2A rights.
New Jersey is about as bad as it gets true. But I expected more of Oregon.
Western Oregon is a PUBLIC university. My sweetie & I almost went to this meeting until we heard they were closing it to the public. Sweetie also did some research & found that the legislature did pass a bill that allowed ‘schools’ to prohibit weapons. But if the DA decided there was no crime, then he understands it only to apply to K-12 - not public universities.
Actually, WOU is a public institution supported by the taxpayers of the State of Oregon.
