HR 45, gun licensing act, 1/6/09

To provide for the implementation of a system of licensing for purchasers of certain firearms and for a record of sale system for those firearms, and for other purposes. Sponsor: Rep Rush, Bobby L. [IL-1] (introduced 1/6/2009) Cosponsors (None)

Latest Major Action: 1/6/2009 Referred to House committee. Status: Referred to the House Committee on the Judiciary.

Blair Holt's Firearm Licensing and Record of Sale Act of 2009 - Amends the Brady Handgun Violence Prevention Act to prohibit a person from possessing a firearm unless that person has been issued a firearm license under this Act or a state system certified under this Act and such license has not been invalidated or revoked. Prescribes license application, issuance, and renewal requirements.

Prohibits transferring or receiving a qualifying firearm unless the recipient presents a valid firearms license, the license is verified, and the dealer records a tracking authorization number. Prescribes firearms transfer reporting and record keeping requirements. Directs the Attorney General to establish and maintain a federal record of sale system.

Prohibits: (1) transferring a firearm to any person other than a licensee, unless the transfer is processed through a licensed dealer in accordance with national instant criminal background check system requirements, with exceptions; (2) a licensed manufacturer or dealer from failing to comply with reporting and record keeping requirements of this Act; (3) failing to report the loss or theft of the firearm to the Attorney General within 72 hours; (4) failing to report to the Attorney General an address change within 60 days; or (5) keeping a loaded firearm, or an unloaded firearm and ammunition for the firearm, knowingly or recklessly disregarding the risk that a child is capable of gaining access, if a child uses the firearm and causes death or serious bodily injury.

Prescribes criminal penalties for violations of firearms provisions covered by this Act.

Directs the Attorney General to: (1) establish and maintain a firearm injury information clearinghouse; (2) conduct continuing studies and investigations of firearm-related deaths and injuries; and (3) collect and maintain current production and sales figures of each licensed manufacturer.

Authorizes the Attorney General to certify state firearm licensing or record of sale systems.

This last election cycle, as well as that of '06 has proved to me that the government will be able to do whatever it pleases without any problems whatsoever. I'm afraid that beyond ranting and raving on various forums, you'll hardly hear a peep.

Unfortunately, brushcop, you are one of the few on this forum who reads the tea leaves as they are, not as we'd wish them to be. The patriots left, especially those anonymous bigtalkers on FR, can easily be isolated, disconnected and demonized one at a time. There will be no popular Alamo rallying point.

Each admirable holdout will be branded as a polygamist, child molester, religious zealot, or worse, a Palinite Conservative and they will be cornered and isolated while the rest of the country lets it happen.

Just ask anyone on a day FR goes down for a couple of hours how prepared they are that day for a "no-knock" at the door.

Furthermore, I'll even tell you how they'll be able to do it!

Instead of the 19 hijackers on 9/11, give them a deer rifle and a scope and put them in the trunk of an impala like John Muhammed did it in the DC Sniper shootings. Spread those 19 guys out all over the country and multiply the mayhem those two caused by 10, all at once.

Since the badguy is a sniper, he erases our argument for guns for self defense because you can't see a sniper to shoot back. So, Bobby Rush and pals will suggest that all honest citizens should want to turn in their guns, as "only terrorists need guns." And the rest of the sheeple will agree to hope and change for the 2nd Amendment.

Case closed, country gone.

these asshats that write bs *law* dont get jacked up for violations, but let a serf not see the new fine print and its off to the slammer and revocation [in theory] of Rights...

One possible response will be to compel every CCW to use their license and carry it! And if he see’s something like an Impala with it’s trunk puffing gun flash while people die, they smoke it. Maybe the terrorists take out more people but the argument for disarming the people is null and void the first time that happens.

After reading all this, and thinking on it for a while, I would say, if they are looking for Civil War II or American Revolution II, this is the perfect way to get it started.

I cant imagine any fool thinking he wanted to be a cop these days. That badge is going to be the first target to go.

Or, more likely, the gun grabbers highlight the first time a well-meaning citizen mistakenly shoots an innocent in a "smoked" Impala, and we lose by popular acclaim.

Understand the reality here. The Constitution relies on the will and vigilance of the majority of the people. And the majority of people could be indifferent today and admamantly opposed to the 2nd amendment tomorrow, leaving us in an unprotected minority very quickly.

Do you think not having weapons will stop what's coming? And honestly, do you believe criminals will be without firearms? I know many fine, upstanding, law-abiding citizens that will become criminals the second any bill like this one is passed into law. Those law-abiding citizens will not freely hand over their firearms. Will you?

I agree up to the point you mention “The Constitution relies on the will and vigilance of the majority of the people.” Actually, it doesn’t. A Republic protects the minority. A very good post on FR not long ago...

True at founding, false now.

This country is no longer a Constitutional Republic.

It was at its founding, and up and until Appomattox 1865.

At that point it became a centralized, consolidated federal democracy.

The states have no practical power to contradict the fedgov.

Not only can the states no longer withhold any meaningful revenue from the Fedgov (direct income withholding) but the states must modify their sovereign authority in order to receive back those funds (i.e. state laws must be in accordance with federal guidelines to receive highway funds back.)

The states are no longer sovereign, and the 9th and 10th amendments are meaningless.
